Two civil jury panels award no damages

Two civil jury panels awarded no damages following trials held recently in Carbon County court. Both cases stem from automobile accidents.

The cases involved Kevin Corcoran and Michael Penczak, of Philadelphia, against Scott Duane, of Jim Thorpe; and Michael and Erica Torrisi, of Jim Thorpe, against Diane Rossi, of Mocanaqua, Luzerne County.The case involving Corcoran, Penczak against Duane was filed as the result of an accident that occurred on March 17, 2006, along Maury Road in Penn Forest Township.The plaintiffs alleged negligence against Duane for causing the crash and the injuries they sustained. The case first went before a board of arbitration which awarded each plaintiff $5,000 damages.Duane appealed and asked for a jury trial. Duane admitted he was negligent in the operation of his vehicle at the time of the crash but denied causing the harm to the plaintiffs. The jury panel ruled that Duane was not negligent in causing harm to the two plaintiffs.The case involving the Torrisi's and Rossi stemmed from a crash that occurred on April 6, 2008, along Indian Hill Road, in Lehighton, near the intersection with Overlook Drive.In that case the jury found Rossi was negligent, but also ruled that the negligence of Rossi did not cause any harm to the plaintiffs.The Duane case was held before Judge Steven R. Serfass and the Rossi trial before Judge Joseph J. Matika.
