District Attorney James P. Goodman made a motion to dismiss the charges of identify theft against Arthur A. Marrin, 18, of 41 Howard Avenue, Coaldale, because the victim did not wish to proceed with prosecution. The motion was granted by President Judge William E. Baldwin.Admits guiltJoseph A. Berardi, 32, Pottsville, pleaded guilty to a charge of retail theft before Judge Cyrus Palmer Dolbin after a hearing and his guilty plea was accepted but sentence was deferred to Oct. 27. The court ordered the probation department to prepare a pre-sentence investigation for court and counsel.Revoke ARDJonathan Jacome, 21, of 210 S. Fifth St., West Hazleton, was removed from the Accelerated Rehabilative Disposition (ARD) probation program for violating the rules. This is a one time program for first offenders who were charged with non-violent crimes.President Judge William E. Baldwin, after a hearing, revoked Jacome's probation and he now faces trial for a drug charge.Hit by falling limbDaniel Rex, 256 N. Second St., Lehighton, filed a civil action seeking damages in excess of $50,000 for alleged injuries suffered when struck by a falling limb of a tree.The suit names Darryl Everett, Lebanon, and John Weiser, 433 Saint Peter's Road, Andreas, West Penn Township, as defendants. The suit alleges Weiser asked him and Everett to remove a tree on Weiser's property and during the course of the operation while Everrett was cutting the limb it landed on Rex causing him injuries to his back and a broken ankle.JailedMelissa Jean Hines, 36, Pottsville, who was brought to a court hearing on a bench warrant issued last June 13 was sentenced by Senior Judge D. Michael Stine to be remanded to the county prison to await trial on charges of driving under the influence (DUI) of intoxicants. She was cited by Schuylkill Haven Patrolman Kenneth Jacoby, on Nov. 2, 2008.Eric Scott Cobb, Reading, was brought before Judge Stine on a bench warrant and after a hearing the warrant was vacated and bail reinstated at $1,500 percentage cash. Also, Cobb must reside with his father at 136 Pear St., Reading, and not to relocate without court approval. Cobb faces charges of simple assault and harassment filed by Trooper Todd W. Heintz.No money backRaymond R. Hillibush, Mahanoy City, lost his appeal in the Commonwealth Court of Pennsylvania to recover $320 confiscated by Mahanoy City Cpl. Michael Dissinger, on Feb. 14, 2009, from his home. He claimed the money was not from drug sales but part of his income of a tax refund.The higher court agreed with the county court and ruled "There is a preponderance of evidence that a nexus (connection) existed between the money found on Hillibush and his illegal drug activity and thus, the money was presumptively forfeited.The court did not find the appellant's explanation of the use and intended use of the money to be creditable. "Police also reported finding 21 bags of heroin in the home. Dissinger pleaded guilty to drug charges in September 2009 and is serving a one to two years sentence in a state correctional institution.Credit card defaultAdvantage Assets II Inc., Mount Laurel, N.J., filed suit against Thomas Solata, 649 S. Kenneth Drive, McAdoo, alleging he has an unpaid balance of $51,707.14 on his credit card.Portfolio Recovery Association, LLC, Philadelphia, filed suit against Christy Carlin, 663 S. Hancock St., McAdoo, alleging a balance of $10,344.72 is owed on the credit card.Drug dealerJalil Donald Ruiz, 25, last known address 27th St., Easton, pleaded guilty to delivery of a controlled substance in the borough of Tamaqua last October and was sentenced to serve 12 to 24 months in a state correctional institution. He also was ordered to make restitution of $360 to Tamaqua Police Department Drug Task Force and $113 to state police. Ruiz was cited by Tamaqua Sgt. Richard Weaver.Loan defaultSusquehanna Bank filed suit against Robert H. Anderson, doing business as Anderson and Anderson Upholster, 114 W. Sherman St., McAdoo, alleging he has defaulted on repaying a loan and a judgement of $16,754.49 is sought.Seek property razedBorough of Tamaqua seeks court action to allow the borough to raze a deteriorated building at 525 N. Railroad St.The suit states the property is owned by Streets Stage Inc., of 480 E. 186th Street, Bronx, N.Y., and that it was damaged by a fire on March 4, 2007. The suit claims the building was allowed to deteriorate to the point it is a dangerous condition, has become infested with rats and rodents which are going into the neighbors' properties. The borough seeks court permission to bring down the building.School taxPanther Valley School District has filed suit against George Fetch and Pamela Bailey, both of 80 Palm Circle, Lehighton, alleging they owe back school taxes on their property at 246 W. Ridge St., Coaldale in amount of $1,188.26.Shenandoah Valley School District filed suit against Joseph N. Feeko, of 55 E. Brandon St., Sheppton, East Union Township, alleging he owes back school taxes on his property on East Centre Street, Shenandoah.Fall in storeJoan Rappold, 72 Hunter St., Tamaqua, filed a civil action against Pieracini's Market Inc., 102 Hunter St., Tamaqua, seeking damages not to exceed $50,000 for alleged injuries she suffered in a fall in the store on Dec. 3, 2009, blaiming the fall on dangerous conditions allowed to exist in the store.File for divorceSandra L. Donnelly, 409 N. Philadelphia Road, Kaska, Blythe Township, started a divorce proceeding against Bryan J. Donnelly, 440 W. Columbia St., Schuylkill Haven. They were married Oct. 24, 2009.Divorce grantedJanet E. Boris, Schuylkill Haven, was granted a divorce from Robert A. Boris, Saint Clair. They were married June14, 1986.Carl D. Brennan, 34, Girardville, had his bail set at $25,000 percentage cash by Judge Stine, which amounts to 10 percent of the aggregate amount of bail. The court also stipulated he must reside at 329 "A" Street, Girardville, and shall not relocate without approval and not posses, use or transport any alcohol or controlled substances.Testimony developed at the bail hearing revealed that while Brennan has ties to this jurisdiction, he has had a history of drug and alcohol abuse and at least one of the offenses involved flight and escape from police which were considered in the setting of the bail.Brennan faces trail on charges of resisting arrest, criminal mischief to a police car, disorderly conduct and driving while operating privileges were suspended which were filed by Girardville Patrolman Peter Wysochansky.
