Thirteen enter guilty pleas in Carbon Co. court

Thirteen defendants in pending criminal cases entered guilty pleas on Thursday in Carbon County court before Senior Judge Richard W. Webb.

Those pleading included:Carl Nelson Gustafson, 39, of Lehighton, pleaded to one count of driving under the influence (DUI) and a summary motor vehicle code violation. He was arrested on Nov. 27, 2010, along Pohopoco Drive, in Towamensing Township. Given a test, the result was .13BAC.Webb placed him on probation for six months and ordered he pay a fine of $300 and get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment. On the summary offense he was fined $25 and costs.Amy Blocker, 25, of Lehighton, pleaded to one count each of DUI and recklessly endangering another person. She was arrested on March 17, 2010, along SR248 in Franklin Township. A test revealed a controlled substance in her system. At the time of the stop she had a three-year-old child in the car which led to the recklessly endangering count.Webb accepted the plea but deferred sentencing and ordered a presentence investigation (PSI) report be prepared by the adult probation office.It was noted Blocker has prior criminal convictions and is currently in the county prison for failure to appear at a prior court proceeding. She is also facing probation violations.Helena A. Barker, 44, of Lansford, pleaded to one count each of DUI and possession of drug paraphernalia. She was arrested on March 8, 2009, by Lansford police along Ridge St. Given a test, the result was .23BAC.On the DUI count Webb placed on probation for six months and a fine of $300. On the possession count she was placed on probation for a year concurrent to the DUI charge. She was also ordered to get a D&A evaluation.Jason Charles McFarland, 34, of Lehighton, pleaded to one count of simple assault. He was arrested on Feb. 17 along S. Fourth St., in Lehighton, involving his then girlfriend, Kimberly Sherry, as the victim.Webb placed him on probation for a year and ordered he have no contact with Sherry, get a D&A evaluation and attend and complete an anger management course.Nioma Beth Bernstein, 38, of Laceyville, Wyoming County, pleaded to one count each of DUI and false identification to law enforcement. She was arrested on July 11, 2010, along SR209 in Franklin Township. Given a test, the result was .23BAC. At the stop she gave police another person's name and also had an expired drivers license.Webb deferred sentencing to a later date.Clayton Berger, 23, of Lehighton, pleaded to one count of criminal conspiracy-theft. He was arrested on March 10, 2008, by Nesquehoning police. He was previously placed in the county's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders but was revoked after having other criminal charges filed against him.Webb placed him on probation for a year and ordered restitution of $612 to victim Robert Blissard and zero tolerance on D&A use. The restitution is half the total with a co-defendant responsible for the other half.It was noted Berger entered a detox center for drug abuse for five days and has been receiving D&A counseling.David R. Snyder, 52, of Lansford, pleaded to one count of DUI. He was arrested on Aug. 29, 2009, along Kline Avenue in Lansford operating a all terrain vehicle (ATV). He refused a blood test and lose his license for a year for the refusal.Webb sentenced him to serve 90 days to five years in jail, a fine of $1,500, license suspended for 18 months and get a D&A evaluation. He will begin the jail term at 9 a.m. on March 28.James Troy Good, 49, of Lehighton, pleaded to one count of DUI. He was arrested on Dec. 29, 2010, along SR248 in Franklin Township. Given a test, the result was .21BAC.Webb sentenced him to serve five days to six months in jail, a fine of $300, license suspended for a year and get a D&A evaluation. He will begin the jail term at 9 a.m. on March 25 and serve it on consecutive weekends of two and three days.Elvin Mercado II, 23, of Brodheadsville, pleaded to one count each of loitering or prowling at night and possession of drug paraphernalia. He was arrested on Aug. 20, 2010, along Broadview Drive in Jim Thorpe.Webb placed him on probation for a year on each count, running consecutively, and ordered he get a D&A evaluation. It was noted Mercado has gone through outpatient D&A counseling program.Charles Pastier, 33, no current address, pleaded to one count of defiant trespass. He was arrested on Dec. 16, 2010, by Franklin Township police for an incident to the rear of 775 Rock St.Webb placed him on probation for a year and ordered he get a mental health evaluation. Pastier is currently in the county prison as he has no residence. Officials are arranging his release to the Allentown Rescue Mission.Thomas L. Nesfeder Jr., 38, of Kunkletown, pleaded to one count of DUI and two summary motor vehicle code violations. He was arrested on July 7, 2010, along SR209 in Franklin Township. Given a test, the result was .20BAC.Webb placed him on probation for six months and ordered he pay a fine of $300 and get a D&A evaluation. On the two summary offenses he was fined a total of $267 and costs.Josh Frank Christman, 29, of Weissport, pleaded to two counts of DUI in two separate incidents. He was arrested on June 3, 2010, along Bridge St., in Lehighton. Given a test, the result was .24BAC. The second arrest occurred on Oct. 18, 2010, along N. First St., in Lehighton. Given a test, the result was .23BAC.On the first count Webb placed him on probation for six months and ordered to pay a fine of $300. On the second count he was sentenced to serve 72 hours to six months in jail, a fine of $1,000, and license suspended for a year. He must also get a D&A evaluation. The sentences run consecutively.He begins the jail term at 7 p.m. on April 1.Kevin Elmer Meckes, 58, of Lehighton, pleaded to two counts of DUI in two separate incidents. He was arrested on July 28, 2010, along Interechange Road in Towamensing Township, by state police, after being involved in an accident at the entrance to his home. Given a test, the result was .24BAC. The second arrest occurred on Nov. 29, 2010, along Forest Inn Road in Towamensing Township. He refused a test in that incident and will lose his license for a year for the refusal.On the first count Webb sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension and get a D&A evaluation. On the second count the same jail time and other conditions were imposed, all running consecutively.He will begin his six day jail term on April 8 at 9 a.m.All defendants must also pay court costs and a $50 per month supervision fee while on probation or parole.
