Kunkletown woman admits driving with a .527 BAC

A Kunkletown woman pleaded guilty in Carbon County court on Thursday to driving under the influence (DUI) with a blood alcohol content of .527 percent. She was one of several to enter a plea before Senior Judge Richard W. Webb.

TowamensingincidentDana Marie Digiovanna, 46, was arrested after state police at Lehighton responded to a reported accident along SR209 in Towamensing Township on Aug. 18, 2009.Troopers found Digiovanna passed out behind the wheel of her car which was in the middle of the road. She was taken to the Palmerton Hospital for treatment of an injury and asked to submit to a blood test. She refused the test, but state police obtained a search warrant for the blood anaylsis done as part of her treatment. A test was run and the high BAC reading was the result.Webb said, "I think that is the highest reading for Carbon County. I never heard of a higher one."District Attorney Gary F. Dobias added, "It's the highest in my 30 years in the DA's office."Digiovanna told Webb she was going through a period of depression and said, "I just didn't want to live." She said she has since addressed her problems and added, "Now I want to live."Webb sentenced her to serve 90 days to five years in jail, a fine of $1,500, ordered to get a drug and alcohol (D&A) and follow any recommendation for treatment, and her license was suspended for 18 months.She was given credit for 27 days spent in a rehabilitation program. She began the jail term at 1 p.m. Thursday.Other DUI'sOther defendants who entered guilty pleas to DUI included:Tiffany Lynn May, 43, of Binghampton, N.Y., pleaded to two counts of DUI for two separate arrests, both occurring along the turnpike.May was arrested on Dec. 4, 2009, after being involved in an accident in East Penn Township. Given a test, the result was .25BAC.May then went to the Pocono barracks for processing on March 3 for the December DUI arrest and was under the influence. Troopers took her for a blood test and it resulted in a .13BAC. She admitted driving to the barracks under the influence.Webb accepted the pleas but deferred sentencing at the request of May. She wants to apply for admission into the county's Intermediate Punishment Program (IPP).Anthony D. Fitzgerald, 29, of Tamaqua, was arrested on July 10 along White Bear Drive in Summit Hill. Given a test, the result was .11BAC.Webb placed him on probation for six months and ordered he pay a fine of $300 and get a D&A evaluation.Jarred Ricky Lee West, 19, of Lehighton, was arrested on June 23, 2009, at Springgarden and Abbott sts., in Lansford. A test revealed the presence of a controlled substance. West also pleaded to a charge of recklessly endangering and a summary offense.Webb deferred sentencing and ordered a presentence investigation (PSI) be prepared the the adult probation office.Arthur George Burnhauser Jr., 54, of West Hazleton, was arrested on July 2 at Rhume St. and Mermon Ave., in Nesquehoning. He refused to submit to a blood test and will lose his license for a year.Webb accepted the plea but deferred sentencing and ordered a PSI. Webb noted Burnhauser has six prior DUI convictions, but all occurring in the 1990s.Barbara A. Wood, 44, of Jim Thorpe, was arrested on May 4 along SR903 in Kidder Township. Given a test, the result was .17BAC.Webb sentenced her to serve 30 days to six months in jail, a fine of $750, get a D&A evaluation and license suspended for a year.She will serve two days in jail and 28 in the county's IPP with electronic monitoring. She begins the jail term at 9 a.m. on Saturday, Oct. 16.Scott L. Fairweather, 32, of Summit Hill, was arrested on Dec. 19, 2009, along Bertsch St., in Lansford. Given a test, the result was .19BAC.Webb placed him on probation for six months and ordered he pay a fine of $300 and get a D&A evaluation.Each defendant must also pay court costs and a $50 per month supervision fee while on probation or parole.
