A Tamaqua man elected to waive a preliminary hearing on driving under the influence (DUI) related charges when he appeared before District Judge Stephen Bayer, Tamaqua, last week.

Michael T.K Boyer, 20, of 211 W. Broad St., was scheduled for a preliminary hearing on charges of DUI, driving at an unsafe speed, operating a motor vehicle without the required financial responsibility (insurance), underage drinking and careless driving.The charges were filed by Tamaqua Patrolman Thomas Duarte after the officer observed Boyer driving at a high rate of speed in the borough on June 26. A blood test done at the Pottsville Hospital indicated Boyer had a .17BAC, more than twice the legal limit of .08.Boyer was released on his own recognizance.Other cases scheduled before Bayer last week included:Terrence Love, of 16 S. Centre St., Pottsville, formerly of Tamaqua, had one charge withdrawn and waived two others to county court during his hearing. Love will face trial on charges of arson and reckless endangerment, while a second arson charge was withdrawn by arresting officer Tamaqua Patrolman Michael Hobbs. Love allegedly started a fire in the living room of a Tamaqua home on June 16.Love was released on $25,000 unsecured bond with several special conditions attached.David G. Hudock, 35, of 112 Windy Rd., Sugarloaf, waived a hearing on a charge of DUI. He was cited by West Penn Township Police Chief Brian Johnson following a July 1 incident.Hudock was released on his own recognizance.David J. Swedo, 38, of 106 E. Jackson St., McAdoo, waived a hearing on charges of theft from a motor vehicle and disorderly conduct, stemming from a June 13 incident. The arresting officer was McAdoo Patrolman Joseph David, who withdrew charges of theft by unlawful taking.Swedo was released on his own recognizance.Steven Deskiewicz, 21, of 412 E. Union St., Tamaqua, waived a hearing on charges of DUI. The charges were filed by West Penn Township Police Chief Brian Johnson following a March 27 incident.Deskiewicz was released on his own recognizance.Robert Allen Toms, 55, of 114 Lucas Ave, Norfolk, Va., waived a hearing on charges of DUI, illegal parking and failure to use a safety belt system. The charges stem from an April 4 incident and were filed by State Trooper Mark Demko.Toms was released on his own recognizance.Steven Berger, 22, of 14 W. Broad St., Tamaqua, waived a hearing on a charge of retail theft, filed by Rush Township Acting Chief Duane Frederick. The charge stems from a March 28 incident.Berger was released on his own recognizance with several special conditions imposed.George C. Hoffman, 44, of 2103 Independent Rd., Breiningsville, was in court to plead to charges in two cases.In the first, from a July 20 incident, he waived a hearing on charges of providing false identification to law enforcement, making a false report and identity theft. He was charged by West Penn Township Patrolman Jeremy Talanca.Hoffman was released on his own recognizance.In a second case Hoffman was charged with identity theft, unsworn falsification, providing false identification to law enforcement, driving an unregistered vehicle and driving with a suspended registration. He was charged by State Trooper Mario Pompei following a July 29 incident.Hoffman was released after posting $25,000 straight bail.Amy Lynn Zapotosky, 31, of 226 E. Washington St., McAdoo, waived a hearing on charges of open lewdness and disorderly conduct, filed by McAdoo Patrolman Joseph David. The charges stem from a July 9 incident.Zapotsky was released on her own recognizance.Susan Whalen, 54, of 1246 Tumbling Run Rd., Tamaqua, waived a hearing on charges of possession of drug paraphernalia and public drunkenness stemming from a June 26 incident. Ann additional charge of possession of marijuana was withdrawn by arresting officer Duane Frederick of the Rush Township police.Whalen was released on her own recognizance.
