Lehighton man waives his hearing on charges he raped sleeping girl

A Lehighton man, charged with raping a sleeping female on Christmas Eve, agreed yesterday to enter a guilty plea and waived a hearing on the counts.

John Nathaniel Lyles III, who has a North Second Street address but is currently lodged in the Carbon County Prison, faces charges of raping an unconscious victim, sexual assault, two counts of aggravated indecent assault, indecent assault without consent of other, and indecent assaault of person unconscious.Coincidentally, Lyles is scheduled to appear in Carbon County Court today regarding unrelated charges of marijuana possession and being engaged in fighting. He also is awaiting the disposition in Carbon County Court of unrelated charges of DUI.Yesterday's hearing on the rape charges were scheduled to be heard before District Judge Edward M. Lewis of Jim Thorpe.The charges stem from an incident in Lehighton. There were witnesses prepared to testify against Lyles at yesterday's scheduled hearing.Chief of Police Matthew Bender of the Lehighton Police Department is the arresting officer.Bender wrote in the affidavit that he was dispatched to a residence in Lehighton and spoke to the victim, who said Lyles raped her. He said the victim was asleep and woke up while Lyles was performing the act.The affidavit says, "The victim, when she woke up, started to kick the offender off of her and push him back. The victim ran out of the apartment to the neighbor's house where she called the police."
