First Niagara Bank, N.A., successor by merger to Citizens Bank and Trust Company, Lockport, N.Y., has filed a mortgage foreclosure complaint against Charles A. Kresge Sr., 500 Drift Road, Palmerton, over a property at that address. Sought is $46,494.49, plus interest and costs.

Divorce started

Bobbi Jo Barats-Smith, 179 S. Fifth St., Lehighton, filed against Gary L. Smith, 1800 Mahoning Drive East, Lehighton. They were married April 20, 1996.

Bear Creek case

The Bear Creek Lake Civic Association, 57 Pool Drive, Jim Thorpe, has filed a civil action against Bradley S. and Christina M. Gray, Hockessin, Del., concerning property the defendants own at Lot 9, Section H, Lake Drive Area, in the development.

The association contends the Grays are in violation of the covenants, conditions and restrictions on all properties in Bear Creek Lakes.

The complaint says the Grays completed construction of a shower and sauna on the property that they indicated on documents to BCKCA would be 16 feet from the eastern property line. When they were completed, the suit says, the shows was less than 7-1/2 feet from the boundary line and the sauna was less than 15 feet from the line.

The plaintiff is asking the court to uphold rights it has through the Uniform Planned Community Act and to issue an injunction ordering the Grays to remove the shower and sauna to comply with the development's laws. Also sought from the defendants are reasonable attorney's fees and court costs . The association also asks the court to require the defendants to pay fines that were assessed against them by the association.

Wants lien removed

Daniel l. Seip, 830 Stony Mountain Road, Albrightsville, has filed a complaint against the Mauch Chunk Trust Company, 1111 North St., Jim Thorpe.

The complaint states the property in question is Lot 62 of Long Fellow Court, Albrightsville. Seip says the bank has refused to remove a lien against the property in a timely fashion, which caused him damages.

The plaintiff contends the refusal to remove the lien was intentional and negligent. He is seeking damages, costs and interest in an amount of less than $50,000.
