Anthony Pascoe, 25, of 201 E. Kline Ave. Apt. 4, Lansford, faces charges from an incident which took place on Jan. 23, 2010 at Kline and Walnut streets.

Charges of driving under the influence, driving under suspension, driving a vehicle at (an un)safe speed, careless driving, and duty of driver on approach of emergency vehicle, were filed by Officer Robert Shubeck. According to an affidavit of probable cause:Shubeck was on foot patrol on West Bertsch Street when he heard a vehicle traveling east on Bertsch, coming from Coal Street. He could hear the engine rapidly accelerating as the vehicle neared him and then sped past him. It was traveling much faster than was reasonable and prudent for a residential street.Shubeck got into his cruiser and got behind the vehicle, a red Ford Taurus, on Bertsch at Springgarden Street. There, he activated his lights. The vehicle failed to stop, and turned right, so Shubeck activated his siren. He saw there was only one occupant, who was not yielding to the police cruiser. As the Taurus turned left onto Kline Avenue, Shubeck again activated his siren.The driver did not respond, so Shubeck activated his siren continuously from about halfway down Kline to Walnut Street, where the Taurus turned left and the driver pulled in to park on the west side of the street.Shubeck asked the driver, identified as Pascoe, if he had seen the lights and heard the siren. Pascoe said he had. Shubeck asked him what he was doing, and Pascoe said he was trying to pull in and park by his house. Shubeck explained that he cannot do that when police have their lights and sirens on behind him, that he has to stop immediately and not park somewhere near his house.Shubeck could smell alcohol on Pascoe's breath, and asked him how much he had to drink. Pascoe said he had had a couple of beers and shots and said to "just take me for DUI."Shubeck said he would determine if he needed to take him in a few moments, and asked for his license and registration. Pascoe said he didn't have a license, as he searched for the registration card. He said his license was suspended.Shubeck ran a records check and confirmed that Pascoe's license was suspended for DUI. He asked Pascoe to perform field sobriety tests. Pascoe's eyes were very glassy and watery, and his pupils dilated. He demonstrated an extreme lack of balance and coordination. Pascoe swayed back and forth as Shubeck talked to him. He failed the tests in every aspect, and was charged.Pascoe was taken to St. Luke's Miners Memorial Hospital, Coaldale, for blood tests, which he refused. He told Shubeck this would be his third DUI charge.
