Seeks payment

Pleads no defense

Donald George Ignatovic, 21, Shenandoah, entered a plea of nolo contendere to a charge of failing to comply with registration requirements as a sexual offender under the Megan's Law and was sentenced by Judge Cyrus Palmer Dolbin to serve 21 to 42 months in a state correctional institution.

Sues club

A property owner in the Lake Hauto development in Rush Township filed a civil suit against the management of the development for alleged water damages caused to a piece of property.

The action was started by Michelle K. Griffiths, 10 Spruce Terrace, and is against Lake Hauto Club which manages the development. The suit states that Spruce Terrance is an island and cul-de-sac, both which are situate to the northern side of her property and which is maintained by the club.

File for divorce

Lawrence Petrole, 724 Claremont Avenue, Tamaqua R.D., started a divorce action against Sara Petrole, 346 W. Blaine St., McAdoo. They were married July 10, 2004.

Jennifer K. DeMarco filed suit for divorce against Jason DeMarco, both of 218 Clay St., Tamaqua. They were married June19, 2004.

Foreclosure

U.S. Bank National Association filed against Michael D. Hannoch, 94 Grier Avenue, Barnesville, a complaint in mortgage foreclosure against his property claiming the principal owed on the mortgage was $68,478.81 plus interest and costs.

Revenue from deeds

Carbon County Recorder of Deeds Emmett P. McCall reported his office recorded 176 deeds, 216 mortgages and 414 other writs during the month of March.

As a result of those transactions, McCall turned over to the Carbon County General Fund the sum of $28,963.35. A breakdown of that revenue includes: transfer fees, $23,927; data processing fees, $1,917.01; notaries, $140; commission on transfers and writs, $1,858.54; and Affordable Housing administrative fee, $1,120.80.

Revoke ARD

Six defendants were removed by Senior Judge D. Michael Stine from the Accelerated Rehabilative Disposition (ARD) probation program for first time offenders, after a hearing held in the Schuylkill County Court. They were:

Joseph Talma Beaufort, 21, Pottsville, for failing to notify his probation officer of a new arrest. His case was returned to the trial list and he faces charges brought by Pottsville Patrolman Eugene M. Yourey, of possession of a small amount of marijuana and drug paraphernalia.

Roof repair dispute

Floyd and Marian Hoffman, 190 Decker Lane, Weatherly, filed a civil complaint against Nick Degiglio, general contractor, of 208 E. Centre St., Nesquehoning; Donald Keck, dba, Keck Roofing & Siding Supply Co., 611-617 Maple St., Hazleton; and IKO Manufacturing Inc., 120 Hay Rd., Wilmington, Del.

The suit states the plaintiffs' purhcased shingles from Keck to replace the roof on their residence, at a cost of $5,756. Degiglio was hired to provide labor to replace the roof at a cost of $8,000.

Motion to dismiss

A motion to dismiss petition filed with the county court by a defendant in a pending criminal case, has been denied in a 17 page memorandum opinion issued by a county judge.

Michael T. Degilio, 42, of Dogwood Drive, Bear Creek Lake Estates, Penn Forest Township, a licensed psychologist, filed a motion to dismiss the charges pending against him because the Commonwealth violated Rule 600 which mandates a person charged with a crime must be brought to trial within a certain time frame.

Tamaqua man

William David Lee, 38, also known as Southern Dave, whose last known address was Tamaqua, pleaded guilty to a simple assault charge and was sentenced by Judge John E. Domalakes to serve six to 12 months in the county prison, pay $50 to Criminal Justence Enhancement Account (CJEA) fund, a $50 monthly supervision, make restitution of $812.12 to the Department of Public Welfare, and $50 to the district attorney for a bench warrant issued to bring him to court.

Warrant hearing

Barry Berger, 33, Ringtown, had the bench warrant dissolved by Judge John E. Domalakes after a hearing and his current bail restored with stipulations that he must reside at Bethesda Mission or Paxton Mission, Harrisburg, must not possess nor consume alcohol or illegal substances and must attend all future court proceedings.

He was brought in on a bench warrant after he failed to appear at a district judge's office for a preliminary hearing. The judge ordered his case placed on the next trial list.
