New Ringgold man files suit over liquor license

A New Ringgold businessman filed a civil action against a beer distribution firm in Schuylkill County court over an alleged breach of agreement.

The action was started on behalf of Thomas Scully, 100 Hillside Lane, versus Eagle Beverage Inc., 450 W. Market St., Pottsville, seeking damages of $20,364 together with interest and costs.In the suit Scully claims on June 21, 2011, he entered into an oral agreement with Eagle Beverage to purchase a Pennsylvania Liquor Control Board license for $20,000 and made a down payment of $10,000 with the remainder to be paid after tranfer was completed.In the suit he states in anticipation of a speedy transfer of the license he entered into an agreement to lease the premises owned by the defendant at 221 Market St., Orwigsburg, where he planned to operate a beer distribution business. On August 1, 2011 he began paying a monthly rental fee of $800 and is obligated under the lease to pay rentals until July 31, 2012, which comes to $3,200. He also purchased a beer cooler for $4,000.Scully claims the transfer of the license never took place because the president of Eagle Beverages, William T. Reynolds, did not execute the transfer document and that he learned there were outstanding PLCB violations against the corporation which had to be resolved and fines paid before the license would be transferred. He seeks to recover the money he invested.
