A Philadelphia man was given a probationary sentence in an assault incident that occurred at a Jim Thorpe tavern while a Carbon County man was given a prison term for driving under the influence.

Both defendants previously pleaded guilty to the charges and were sentenced last Friday by Judge Steven R. Serfass.

Jim Thorpe incident

Justin Matthew Schuch

, 24, was placed on probation for 24 months on charge of simple assault.

He was arrested on Feb. 23 when Jim Thorpe police responded to the Union Publick House along Center Street. Schuch was a patron in the bar and was told to leave by the bartender, who said he had enough to drink. While leaving the bar he assaulted the bartender and damaged his vehicle. It was noted that the victim and police agreed to the probationary sentence.

Serfass also ordered Schuch to pay total restitution for medical bills and damages to the vehicle of $1,203.57, zero tolerance for drug or alcohol use, render 100 hours of community service and stay out of the Publick House.

DUI case

Christian Torres

, 22, of Albrightsville, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and one-year license suspension for DUI.

He arrested on Nov. 26, 2016, by state police at Lehighton along Behrens Road in Penn Forest Township. A test revealed the presence of a controlled substance. He was previously placed in the Accelerated Rehabilitation Disposition probation program but revoked from it for violating conditions.

He must also render 25 hours of community service. He was given credit for three days already served in prison on the charge and paroled.

Both defendants must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
