A Luzerne County man admitted to a criminal trespass charge and was sentenced to a prison term.

He was one of five defendants in pending criminal cases to enter a guilty plea before Carbon County Judge Steven R. Serfass.Jim Thorpe incidentRobert James McGee, 36, of Wilkes-Barre, admitted illegally entering the home at 206 Oak St. in Jim Thorpe, on July 11, 2016. At the time McGee was reported to be a former boyfriend of a resident of the home.McGee admitted to a drug addiction problem and since the incident spent time in two inpatient rehabilitation programs and is currently living in a halfway house and continuing counseling.Serfass sentenced him to time-served (110 days) to one day less 24 months in prison and ordered he supply a DNA sample, zero tolerance for drug and alcohol use and render 100 hours of community service.Lehighton incidentsTroy Michael Fairchild, 44, of Lehighton, entered pleas in two pending cases.He pleaded to one count of criminal trespass, as a felony three, for an incident on Sept. 25, 2016, at a residence along South Street in Lehighton. Fairchild had been doing work at the residence and was staying there while doing the work. He was then told to stop working and was no longer allowed to stay at the property. He was found there by police and arrested after being warned to stay away.He also pleaded to one count of flight to avoid apprehension filed for an incident on Sept. 23, 2016. He was in a vehicle stopped by police and had a warrant for his arrest out of Schuylkill County. He fled on foot through various yards in the area. He later turned himself in to police.Serfass deferred sentencing, ordering the adult probation office to prepare a presentence investigation report.Other pleasDavonte Moore, 22, of Heath, Ohio, pleaded to one count of receiving stolen property. He was charged by Jim Thorpe police with taking $45 from Leffler's Mini Mart, North Street, on Nov. 2, 2012, while an employee of the business.He was previously placed in the county's Accelerated Rehabilitation Disposition probation program but was revoked for violating the conditions.Serfass placed him on probation for six months and ordered restitution of $45.Maxine Rae Scherer, 39, of Aquashicola, pleaded to one count of harassment, as a summary offense, with a simple assault count dropped in a plea bargain.Scherer was arrested on Aug. 7, 2016, in Towamensing Township by state police at Lehighton for assaultinga man. First Assistant District Attorney Michael S. Greek said the victim agreed to the plea to the summary offense and did not wish for the commonwealth to pursue the assault charge.Serfass imposed a fine of $300.Andre Jerry Smith-Morales, 36, of Lansford, pleaded to one count of false identification to law enforcement.He was arrested on Aug. 2, 2016, by Jim Thorpe police following a traffic stop along Route 209, Police stopped the vehicle for Nesquehoning police as part of an investigation into a gas drive-off at a borough business. At the stop Smith-Morales gave a false name, but later admitted who he really was.Serfass placed him on probation for a year and ordered he render 50 hours of community service.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
