A Tamaqua man was among 12 defendants who entered guilty pleas to criminal charges and were sentenced by Judge Charles M. MIller in Schuylkill County court as follows:

Trent Jason Jacoby, 31, of 144 1/2 Spruce St., on a driving under the influenc (DUI) of alcohol charge was sentenced to serve 90 days to five years in the county prison beginning Monday, Oct. 24, at 9 a.m., pay a fine of $1,500, pay $300 to Substance Abuse Education (SAE) fund, $50 to Criminal Justice Enhancement Account (CJEA), $50 to Catastrophe fund, and attend alcohol highway safe driving school.On additional charges of failing to drive on roadways laned for traffic and failing to wear seat belt was fined $50 plus $100 costs. Jacoby was cited by Trooper Thomas Hornung when stopped on SR183 in Wayne Township.Thomas Joseph Gaughan, 49, of 10 N. Kennedy Drive, McAdoo, on a charge of theft by unlawful taking of seven flags donated by VFW Lodge and displayed outside police station, was placed on probation 12 months, fined $50, and pay $50 to CJEA.He also pleaded guilty to possession of a small amount of marijuana and drug paraphernalia and received a concurrent 12 months probation sentence, pay $100 to SAE fund and $50 to CJEA. Gaughan was cited by McAdoo Chief Jeffrey Wainright.Robert Jesse Morris, 19, Coudersport, on a charge of DUI was sentenced to serve 48 hours to six months in the county prison and when he completes his 48 hours to be released on parole for the balance of his sentence, pay a fine of $500, pay $100 to SAE fund, $50 to CJEA, $50 to Catastrophe fund, attend alcohol highway safe driving school and driver's license suspended 12 months.On a summary charge of exceeding the speed limit by 25 miles per hour was fined $94.50 plus $50 costs and on a charge of failing to yield to an emergency vehicle was fined $25 plus $50 costs. Morris was cited by Trooper David Mayes when stopped on Interstate 81 in Pine Grove Township.William Alex KIistler, 27, Cressona, drew a sentence of six to 12 years in a state correctional institution on charges of burglary and theft and was ordered to make restitution as follows: for burglary at Red and White Market, North Manheim Township, $1,801.91; forging checks of Melissa Strouse, Orwigsburg, $491; theft at Hess Catering Service, Schuylkill Haven, where he was employed, $377; theft of lottery tickets from Sam's Place, Cressona Mall, $100; theft from Greg A. Stewart, Orwigsburg, $50; M&T Bank, $978.19; theft from Anthony Floyd, Orwigsburg, $400; and theft from Jason Huseman, Cressona, $300. He also must pay $450 to CJEA. He was cited by state police.Jason Bivins, 32, Parkesburg, Chester County, on a charge of possession of drug paraphernalia was placed on probation 12 months, pay $50 to CJEA, make restitution of $113 to Bethlehem Regional Lab, and $40 to Schuylkill County Drug Task Force. He was cited by Shenandoah Capt. George Carado.Russell F. Mauger, 49, Shenandoah, on a charge of DUI the sentence was deferred until Tuesday, Dec. 27, as the court ordered a presentence investigation (PSI) report prepared by the adult probation department. Mauger was cited by West Mahanoy Township Patrolman Robert Senapewhen stopped on SR924.Edward J. Simon, 44, Mahanoy City, on charges of disorderly conduct and public drunkenness was fined $300 and pay $50 to CJEA. Simon was cited by Mahanoy City Patrolman Charles Kovaleski.Richard Paul Davidson, 34, Shenandoah, on a charge of delivery of a controlled substance (CS) was sentenced to serve 11 to 23 months in the county prison with credit for serving 20 days, fined $200, pay $100 to SAE fund, $50 to CJEA, make restitution of $176 to Bethlehem Regional Lab and $40 to District Attorney's Drug Task Force. He begins his sentence on Wednesday, Nov. 2, at 9 a.m.Jeifri J. Graciano-Suazo, 22, Shenandoah, on a charge of delivery of a CS was sentenced to serve three to 23 months in the county prison with credit for serving 18 days, fined $200, pay $100 to SAE fund, $50 to CJEA, make restitution of $113 to Bethlehem Regional Lab and $30 to Schuylkill County Drug Task Force. He was cited in Shenandoah.Robert John Herstek, 42, Kingston, on a charge of possession of drug paraphernalia was sentenced to serve 12 months probation, pay $100 to SAE fund, and $50 to CJEA. Herstek was cited by McAdoo Patrolman Shawn KIstler.Patrick Eugene Schartel Jr., 23, Saint Clair, on a DUI charge was sentenced to serve 72 hours to six months in the county prison and on a charge of furnishing liquor to minors to serve an additional 12 months on probation, fined $1,000, pay $300 to SAE fund, $50 to CJEA, and $60 to Schuylkill Medical Center.On a charge of driving while his operating privileges were suspended pay a fine of $200 and failing to drive on roadway laned for traffic was fined $25 plus $100 in costs. On the DUI charge he was cited by New Castle Township Patrolman Edward Romanchik, and on the charge of selling to minors was cited by Saint Clair Patrolman Chad H. Seitzinger.Justin R. Watson, 30, Schuylkill Haven, on a DUI charge was sentenced to serve 72 hours to six months in the county prison beginning Friday, Oct. 28, at 9 a.m. and when he completes the 72 hours to be released on parole, fined $1,000, pay $300 to SAE fund, $50 to CJEA, $50 to Catastrophe fund, complete safety school and driver's license suspended 12 months. Watson was cited by Trooper Kurt S. Salak.Each defendant must also pay other court costs and a $50 per month supervision fee while on probation or parole.
