Mousseau confirms nomination rescinded

Gov. Edward Rendell has rescinded his nomination of Jim Thorpe attorney Gregory Lee Mousseau, just days after he made the nomination.

The nomination was to fill a vacant judgeship in the Carbon County Court of Common Pleas - created after Judge David W. Addy passed away on Dec. 17, 2009 - until a new judge could be elected in November 2011.Senior Judge Richard Webb is filling in for the time being.Mousseau, this morning, confirmed with the TIMES NEWS that he had received word on Tuesday afternoon, that his nomination for the judgeship was being rescinded by the governor.Attempts to obtain official information from Rendell's office about the nomination being rescinded were unsuccessful as of press time, as press officials stated they were not aware of the situation.Mousseau stated that he was surprised by the nomination earlier this month because it "came out of the blue." He said he was honored to even be considered for the position, even if it was only for a short time."I am very thankful and grateful that Gov. Rendell would nominate me to the position held by the late Judge Addy," Mousseau said. "It is an honor and a privilege to be considered but I understand the political process. I am very blessed to be living in Carbon County."Mousseau noted that he was unaware that he was up for the nomination until last Friday, when he received word from the governor's office.When contacted about Mousseau's nomination being rescinded, Carbon County Commissioner C hairman William O'Gurek, Democrat, said he was surprised by Rendell's initial nomination because it differed from the arrangement that he, Commissioner Wayne Nothstein, a Republican, and Carbon County Judges Roger N. Nanovic and Webb had agreed upon after Addy's death."From a county standpoint," O'Gurek said, "we were obviously confused because we had met with the president judge earlier this year to work out a game plan to meet our court's needs. That game plan was, and we believe still is, for neither party to pursue an appointment (of a judge) because Nanovic and Webb had indicated to us that Judge Webb would handle the court's needs. Judge Nanovic transferred all of Judge Addy's cases to Judge Webb and those cases have been taking place this year and will throughout all of next year until a judge is elected by the people."Mousseau ran for the third county judgeship in 2009 but lost the Republican nomination to Steven R. Serfass. Serfass went on to win the election in November. He took office and became the county's 17th judge on Jan. 1.Efforts by the TIMES NEWS this morning for comments from Speaker of the House Keith McCall (D-Carbon); state Sen. David G. Argall, who reportedly recommended Mousseau for the nomination, were unsuccessful.
