Mahoning approves banquet hall in barn

Mahoning Township supervisors voted 3-1 Wednesday for a barn to be used as a banquet facility.

Supervisor Carol Etheridge was opposed. Supervisor Ron Reeser was absent from the meeting.

Supervisors took the action after reconvening the Mudrick conditional use hearing that was previously held on Jan. 14.

Kelly Follweiler and Mudrick Meadows sought conditional use approval to use property located at 211 Semmels Hill Road as a banquet hall.

Follweiler owns the property, which is zoned R-1 Agricultural Rural. A banquet hall is a permitted use in the R-1 Agricultural Rural District as a conditional use.

Supervisors approved the request subject to the following conditions being met:

• Occupancy must be limited to 130 patrons or such other lower number as may be approved by the building code official.

• Any buildings or structures, including the barn, must comply with the Uniform Construction Code.

• With the exception of ground and handheld sparking devices, there is to be no fireworks or pyrotechnics used during events. A sparkling device must consist of a metal wire coated with a chemical composition that produces a shower of sparks, a colored flame and/or a crackling effect, and must have the same meaning as a wire sparkler or dipped stick as defined in Standard for the Construction, Classification, Approval & Transportation of Consumer Fireworks.

• The banquet hall may only be open and operated between April 1 and Oct. 31 of each year.

• Events at the banquet hall may only be held on Fridays, Saturdays and Sundays, although caterers and the like may deliver or set up on any day at the facility.

• Events at the banquet hall must begin no earlier than 3 p.m. and end no later than 10 p.m., although caterers and the like may arrive or leave between the hours of 8 a.m. and 11 p.m.

• Food trucks and other similar methods of outdoor sales of food, goods, distribution or services are prohibited.

• The source of any amplified noise, including music, must be located within the barn.

• The applicants must deliver to the zoning officer a written and notarized document signed by Follweiler evidencing that the applicant is authorized to use the subject premises in the manner described in the application and set forth in the foregoing decision.

• The applicant must provide the zoning officer with copies of any inspection reports prepared by an engineer, architect or any other person which were in possession of the applicants on or before Jan. 28.

• A landscaped buffer in accordance with a section of the zoning ordinance and of the Mahoning Township Subdivision and Land Development Ordinance must be provided along the entire westerly side of the subject premises.

• The applicant must obtain final unconditional approval of a land development plan in accordance with the SALDO.

• The applicant must comply with all provisions of the zoning ordinance, including sections pertaining to noise, surface and groundwater protection, and stormwater management and soil erosion control.

• The applicant must obtain a septic permit approved by the township sewage enforcement officer.

• Unless a variance is obtained from the zoning hearing board, parking spaces need to be illuminated in accordance with sections 116-29C and 116-67 of the zoning ordinance.

• Unless a variance is obtained from the zoning hearing board, parking areas must have a maximum grade of 6% as provided in a section of the zoning ordinance.

• Unless a variance is obtained from the zoning hearing board, the parking area must be paved in accordance with a section of the zoning ordinance.

• A highway occupancy permit must be obtained from the township.

• No active play equipment or recreational inflatables are to be used on the property during events.
