Monroe man convicted in drug death case
An East Stroudsburg man, who distributed a deadly dose of fentanyl to a woman who died in Monroe County in 2023, was convicted in U.S. District Court of drug distribution charges involving a death and faces a maximum penalty of life imprisonment.
Dimitris Smith Jr., 48, was found guilty on Jan. 9 in the Scranton district court following a five-day trial before Judge Karoline Mehalchick.
He was also found guilty of four counts of distribution of fentanyl and cocaine. His sentencing has not yet been scheduled.
According to U.S. Attorney Brian D. Miller, Smith distributed the fentanyl on Dec. 11, 2023, in East Stroudsburg, resulting in the death of a 38-year-old woman who ingested it.
Miller also said between March 14 and April 1 of last year, Smith distributed fentanyl and cocaine to an undercover law enforcement officer during a time period in which he was on federal supervised release from a prior drug trafficking conviction.
During the trial, prosecutors from the U.S. Attorney’s Office presented testimony of 32 witnesses, including experts in forensic pathology, forensic toxicology, serology DNA profiling, forensic chemistry and historical cell site data.
Witness testimony, the victim’s cellphone data and text messages, DNA evidence seized at the crime scene, and CashApp payment records were among the evidence presented that proved Smith was the dealer who supplied the fentanyl that killed the victim.
The jury also found Smith guilty of distributing drugs on four separate occasions after the death of the victim.
The matter was investigated by the Federal Bureau of Investigation and the Pennsylvania State Police.
Assistant U.S. attorneys Jenny P. Roberts and Patrick Bannon prosecuted the case.
