The presiding judge in a Carbon County drug case declared a mistrial Wednesday night after the jury panel told him their were unable to reach a decision.
Eldwin Jose Rubio De Los Santos, 31, of Allentown went on trial on Tuesday charged with possession with intent to deliver a controlled substance and possession of a small amount of marijuana. He was charged by Palmerton patrolman Christopher T. Ritter following a speeding stop along Route 248 on March 7, 2015.At the stop Ritter smelled marijuana coming from the vehicle. Following a search, some marijuana and a large amount was cash was found.President Judge Roger N. Nanovic declared the mistrial around 8:30 p.m. The testimony in the case finished on Wednesday morning with the jury getting the case from Nanovic in the afternoon. The panel had questions for Nanovic during the deliberations, which he answered.The case will not be rescheduled for another trial date.
