Carbon County court - DUI

A Carbon County woman was sentenced to a county prison term on Tuesday on two counts of driving under the influence.

She was one of five defendants sentenced by President Judge Roger N. Nanovic II on DUI charges who previously entered guilty pleas.Judy Ann Evans,70, of Palmerton, was sentenced to serve a total of 35 days to six months in prison on the two DUI counts, pay total fines of $2,250, and license suspension of a total of 30 months.She was also placed in the county's Intermediate Punishment Program for 58 months with the first 50 days spent on electronic monitoring, which begins after her jail term is served. She was given credit for seven days spent in an inpatient rehabilitation program. She will begin the jail term at 9 a.m. on March 21 and serve it on consecutive two-day periods of Monday to Wednesday.She was arrested by state police at Lehighton on Oct. 15 and 23, 2015.Robert M. Pazienza,25, of Kunkletown was sentenced to serve 30 days to six months in prison, then 59 months in the IPP with the first 60 days on electronic monitoring. He must also pay a fine of $1,500 and have his license suspended for 18 months. He was given credit for 26 days spent in an inpatient program. He will begin to serve the remaining four days on consecutive two-day weekends beginning at 8 p.m. March 18.Nancy Bell Kuhn,55, of Jim Thorpe, was sentenced to serve 72 hours to six months, pay a fine of $1,500, and license suspended or a year.She was arrested on Oct. 4, 2015, by state police at the intersection of Behrens and Church roads in Penn Forest Township.James Michael Miller III,22, of Saylorsburg, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, and have his license suspended for one year. On a charge of possession of drug paraphernalia, he was placed on probation for six months, consecutive to the DUI charge.He will begin the jail term at 8 p.m. March 18.He was arrested on April 21, 2015, by state police at Lehighton along Little Gap Road in Lower Towamensing Township.Tammy Lee Newhart,52, of Nesquehoning, was sentenced to serve 48 hours to six months in prison, a fine of $750 and a one-year license suspension. She was arrested on Dec. 19, 2012, along West Broadway by Jim Thorpe police. She was previously placed in the Accelerated Rehabilitation Disposition probation program but was revoked for violating conditions.She will begin the jail term at 9 a.m. March 21.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
