A Palmerton man injured in a car accident nearly six years ago has been awarded over $1 million as part of a jury verdict.
Cody Davis, 22, won a verdict of $1,027,000 last week in Lehigh County court, according to Attorney Kevin Foley, from the Foley Law Firm, Scranton.Davis was a passenger in a vehicle operated by Scott Berger, of Kunkletown, when the accident occurred on Aug. 17, 2006, Foley said.Foley said liability was stipulated to a trial, which he added was solely a question as to the value compensation for wages, medical expenses, and pain and suffering."We do not believe that the insurance company tendered its coverage limits in a timely fashion," Foley said. "Unfortunately, this will probably not be the end of litigation; we'll probably have to file another lawsuit."Foley said the verdict was reached in a jury trial before Judge Alan Black. Attorney Charles Fonzone, of the Fonzone & Ashley Law Offices, Allentown, served as defense council, he said.
