Man charged for carrying gun without permit
A Hazleton man has been charged for carrying a gun without a permit.
According to the affidavit of probable cause filed by trooper Joseph Julian of the Pennsylvania State Police, Hazleton barracks in the case against Joseph Machado:
At 12:01 a.m. Dec. 14, Julian was on patrol with trooper Michael Wychock when they began following a Gold Ram 1500 heading south on Route 93 in Banks Township.
Wychock clocked the truck going 57 mph in a 35 mph zone.
Julian saw it cross over the solid painted double line, then over the solid white line on the right side of the roadway.
Troopers stopped the Ram in the 100 block of Berwick Street in Beaver Meadows.
Machado, 23, was in the driver seat. Machado said he did not have a license on him.
As Julian was talking with Machado, he noticed a strong odor of burned marijuana emanating from inside the vehicle.
As Machado got out of the truck, he was continuously reaching in his pockets and waist area, and Julian saw him throw a black pistol to the driver side floor with his right hand.
Troopers then detained Machado and all occupants of the vehicle.
Julian asked Machado if he had a concealment permit for the pistol, but he said he did not.
While Machado was detained, Julian observed a strong odor of an alcoholic beverage emanating from him, and asked Machado how much he had to drink, and he replied “nothing.”
Machado faces charges of firearms not to be carried without license; carrying a loaded weapon; possession of firearm prohibited; DUI; disregard traffic lane; speeding; and driving while operating privilege is suspended.
He is incarcerated in the Carbon County Correctional Facility in lieu of $350,000, 10% monetary bail, and is scheduled to have a preliminary hearing Jan. 6 before District Judge Joseph D. Homanko Sr. of Weatherly.
