Seven defendants in pending criminal cases were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders.

If a person successfully completes all conditions of the program their record is wiped clean. However, if they fail to complete the program, or are revoked from it, the Commonwealth reserves the right to prosecute them on all pending charges. A person does not admit guilt in entering the program.President Judge Roger N. Nanovic II placed the eight Tuesday, all for one year, unless otherwise noted.Gary Lee Bruch, 56, of Pamlerton, was placed on charges of driving under the influence (DUI) and possession of a small amount of marijuana. He was arrested on Jan. 28 along SR248 in Parryville by state police at Lehighton. Given a test, the presence of a controlled substance was found in his system.He was ordered to pay $450 for the cost of the program, get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, zero tolerance imposed on D&A use, license suspended for 60 days and render 20 hours of community service.Lewis M. Gullone, 53, of Jim Thorpe, was placed on a charges of terroristic threats and disorderly conduct. He was arrested by Jim Thorpe police for an incident that occurred on April 7 along Susquehanna St.He was ordered to pay $350 for the program, get a mental health evaluation, have no contact with the victim-listed as Lisa Haman, and render 15 hours of community service.Kari Elaine Hundley, 24, of Jim Thorpe, was placed on a charge of DUI. She was arrested on March 13 along Center St., in Jim Thorpe. Given a test, the result was .14BAC.She was ordered to pay $400 for the cost of the program, get a D&A evaluation and license suspended for 30 days.Dana B. Lincovich, 28, of Summit Hill, was placed for two years on a charge of fraud in obtaining public assistance illegally filed by the state Department of Welfare. She was accused of receiving over $8,000 in public assistance while not entitled to it.She was ordered to pay $350 for the cost of the program, render 15 hours of community service and make restitution to the state for $8,940.Ora G. Macaluso, 42, of Albrightsville, was placed for two years on a charge of fraud in obtaining public assistance. She was charged by the state Department of Welfare with receiving $4,558 worth of public assistance while not entitled to it.She was ordered to pay $350 for the program, render 15 hours of community service and make restitution of $4,558 to the state.Lukas John Stubbs, 32, of Freeland, was placed in the program on two pending cases including charges of unauthorized use of a automobile and terroristic threats. The first case was filed for an incident on Jan. 31 in which Doris Jean Bershline is the victim. The threats count was filed for an incident on Feb. 3 with Kori Emichetto the victim. The charges in both cases were filed by Weatherly police.Stubbs was ordered to pay $500 for the cost of the program, get a mental health evaluation, attend and complete anger management counseling classes, make restitution, if any, to the victims, and render three hours of community service per month while in the program.Each defendant must also pay court costs and a $50 per month supervision fee while in the program.
