Carbon County court - Parole/probation revocation
Carbon County judges conducted parole/probation revocation hearings on petitions filed by the adult probation office against defendants who violated the terms of their release.
Hearings were held for the following:Ian Thrasher, 39, of Berwick, had his parole revoked on charges of theft on petition of probation officer Clifford Eckhart for violating conditions by testing positive for a controlled substance, failing to pay his court costs, failing to attend and complete drug and alcohol treatment and failing to perform 50 hours of community service.Judge Joseph J. Matika resentenced him to serve six months back time in the county prison. The term runs consecutive to another sentence Thrasher is already serving.John Provisiero, 22, of Easton, had his parole revoked on charges of criminal mischief and harassment on petition of Eckhart for violating conditions by testing positive for controlled substance, failing to engage and complete mental health treatment, failing to perform 50 hours of community service and violating the zero tolerance condition.Matika resentenced him to serve 90 days back time in the county prison effective Oct. 1 and was granted work release if he qualifies.Sherry Phillips, 39, of Lansford, had her probation revoked on a charge of retail theft on petition of Eckhart for violating conditions by being charged with a new criminal offense and failing to attend and complete drug and alcohol treatment.Matika resentenced her to serve 6 to 24 months in a state correctional institution, which is consecutive to a sentence she is already serving.Joshua Green, 24, of Lansford, had his probation revoked on charge of possession of a controlled substance on petition of Eckhart for violating conditions by being charged with a new criminal offense.Matika resentenced him to serve 107 days to 12 months in the county prison with credit for 107 days already served, and paroled him.Dennis Nedley, 32, of Coaldale, had his probation revoked on a charge of furnishing alcohol to a minor on petition of Eckhart for violating conditions by testing positive for a controlled substance.Matika resentenced him to serve 15 to 30 days in the county prison, and must serve the entire 30 days.Patrick McLaughlin, 48, of Albrightsville, had his probation revoked on a charge of driving under the influence on petition of probation officer Joseph Bettine for violating conditions by failing to complete drug and alcohol treatment, failing to complete 50 hours of community service, and failing to complete highway safety program.Judge Steven R. Serfass resentenced him to serve 3 to 6 months in the county prison and must still complete D & A treatment, community service and safety program.Andrew Carino, 28, of Lehighton, had his probation revoked on a DUI charge on petition of probation officer Kimberly Cooper for violating conditions by testing positive for opiates which violated the zero tolerance provision.Matika resentenced him to serve 90 days to 12 months in prison effective June 19 followed by 47 months consecutive probation.Ronald Eidem, 37, of Lehighton, had his parole revoked on a charge of possession of a controlled substance on petition of probation officer Jillian C. McGinley for violating conditions by testing positive for amphetamine.Matika resentenced him to serve 90 days in prison effective June 2.John McCole, 44, of Jim Thorpe, had his parole revoked on a charge of receiving stolen property on petition of Bettine for violating conditions by not making a concerted effort to pay court costs of $1,415.33.Serfass resentenced him to serve two months back time effective Dec. 2 at 9 a.m. If he pays $1,335.33 by that date the order will be vacated.Stephen Gallagher, 32, of Lake Harmony, had his probation revoked on a charge of DUI on petition of Bettine for violating conditions by engaging in overt or assaultive behavior which is deemed threatening to his parents, and possessing on consuming alcohol, which violated the zero tolerance condition.Matika resentenced him to serve 99 days to 1 day less 24 months in prison with credit for 99 days already served, and paroled.Lawrence Mustacchio, 56, of Summit Hill, had his parole revoked on a charge of DUI on petition of Eckhart for violating conditions by failing to report to the probation office as directed, failing to complete highway safety program, failing to complete drug and alcohol treatment and failing to perform 25 hours of community service.Serfass resentenced him to serve 165 days back time in prison with credit for 44 days already served.John Charles Sabol, 52, of Lansford, had his parole revoked on a charge of possession with intent to deliver a controlled substance on petition of Eckhart for violating conditions by testing positive for a controlled substance, failing to submit to a drug screen, failing to engage in D & A treatment and violating the zero tolerance provision.Matika resentenced Sabol to serve 13 months, less a day, back time in a state correctional institution with credit for 15 days already served.Judy Sabol, 36, of Lansford, had her parole revoked on a charge of drug fraud on petition of Eckhart for violating conditions by being charged with a new criminal offense.Serfass resentenced her to serve 12 months back time in a state correctional institution with credit for 129 days already served. The sentence is consecutive to a term she is currently serving.David Rowe, 55, of Palmerton, had his parole revoked on a charge of simple assault on petition of Cooper for violating conditions by not making a concerted effort to pay court costs, not completing anger management classes and not completing 100 hours of community service.Serfass resentenced him to serve 90 days back time effective Sept. 13 at 9 a.m.Rodney Rider, 34, of Jim Thorpe, had his parole revoked on a charge of DUI on petition of probation officer Toby Butz for violating conditions by failing to report to the probation office as directed and his whereabouts were unknown.Nanovic resentenced him to serve out is maximum date in prison which is Jan. 20, 2019. The order also states he is eligible for parole after completing a D & A evaluation, complete the highway safety program and pay all court costs.Peter Hydro, 47, of Jim Thorpe, had his probation revoked on a charge of persistent disorderly conduct on petition of probation officer Derek George for violating the zero tolerance for alcohol use condition.Nanovic resentenced him to serve 90 days to 12 months in prison with credit for 52 days already served.
