A Carbon County man was sentenced to a county prison term on Thursday after he admitted assaulting his mother and resisting arrest.

Gustavo Rosario Jr., 32, of Lehighton, pleaded to one count each of simple assault and resisting arrest before Judge Steven R. Serfass.On Jan. 7, Lehighton police responded to the 100 block of Iron Street for a reported assault.On scene, officers learned that Rosario got into a dispute with his mother and assaulted her. When taken into custody and being placed in a police cruiser he kicked officer Jason Doll, who was assisting officer Michael J. Svetik in the arrest.Serfass rejected a request by defense counsel, attorney Hollianne C. Snyder of the public defender's office, to sentence Rosario to a time served sentence citing mental health issues the defendant has and that his mother also has such problems. She said Rosario was off his medication at the time of the incident.Rosario told Serfass, "I just apologize to the officers. I wasn't taking my meds."Serfass said he had to take into consideration the fact Rosario assaulted a police officer, the situation involving his mother and for the protection of the public in rejecting a time-served sentence of 180 days. Serfass sentenced him to serve nine to one day less 24 months in prison on the assault count and three to one day less 24 months on the resisting charge with the terms running concurrently.Rosario was also ordered to get a drug and alcohol evaluation, pay court costs of about $1,000 and when released on parole pay a $50 per month supervision fee.Rosario, who has been in prison since the incident, was given credit for the 180 days already served.
