Court documents report assault of Albrightsville teen
Court documents say an Albrightsville couple has been sexually assaulting a teenager for more than five years, with the man accused of fathering a child with her when she was 17.
According to the affidavit of probable cause filed by Trooper Bridgette Flanigan of the Pennsylvania State Police, Fern Ridge barracks, Debora Westgate, 30, and James Westgate Jr., 38, face multiple charges.
On Jan. 13, the girl went to the Fern Ridge barracks to speak to a trooper regarding obtaining a protection from abuse order and to ask questions regarding child custody.
The affidavit states the victim said the sexual abuse by her relatives began at age 13, and that she has a 1-year-old child with James Westgate Jr.
The PSP Fern Ridge Criminal Investigation Unit and the Children’s Advocacy Center of NEPA opened an investigation.
The abuse began while the victim was living in Clayton, Delaware, around 2019, and continued after they moved to Penn Forest Township in March or April of 2020, the affidavit states.
Police said the girl reported the abuse was ongoing.
James Westgate faces charges on two counts of aggravated indecent assault - complainant less than 16 years of age, and one count each of statutory sexual assault - 11 years older, deviate sexual intercourse and sexual assault.
Debora Westgate faces charges of deviate sexual intercourse with person less than 16 years of age, aggravated indecent assault - complainant less than 16 years of age, sexual assault, indecent assault of person less than 16 years of age, corruption of minors, and incest of minor.
Both are currently being held in the Carbon County Correctional Facility in lieu of $250,000 monetary bail. Preliminary hearings are scheduled for April 8 before District Judge Eric M. Schrantz of Jim Thorpe.
