Delivery man charged for firing gun

West Penn Township police have arrested a delivery driver on felony and misdemeanor charges after court documents showed he fired a gun into the ground after an apparent verbal altercation with a resident who yelled to him to slow down.

David J. Lopez, 23, of Leola, was arraigned before Magisterial District Judge Anthony J. Kilker on felony charges of aggravated assault and firearms not to be carried without a license, and misdemeanor charges of terroristic threats, crime committed with a firearm and reckless endangerment.

He was committed to the Schuylkill County Prison, Pottsville, in lieu of $100,000 bail.

Court records indicate the incident took place on Monday night on Forsythia Lane in the township. They show a resident reported a delivery driver, later identified as Lopez, was speeding down a dirt lane toward a neighboring residence.

The resident told police he yelled at Lopez to slow down, after which the driver stopped, got out of his vehicle and the pair began yelling at each other.

Police said Lopez then pulled out a gun and pointed it at the resident, telling him he was going to shoot him. He fired a round into the ground, got back into his vehicle and drove away.

Police said they later found a 9 mm shell casing on the ground where the driver had been standing.

They said they went to the residence where Lopez ultimately made a delivery from Walmart and the resident’s delivery notification showed a picture of the driver, who had the name Dave.

Police said Walmart associates verified the package was sent from their stores and that Lopez was the driver.

An asset protection person at the Walmart in Saint Clair told police Lopez was on his way back to make another delivery, but said they would delay the order until police arrived.

Records show contact was made with Saint Clair police officers, who detained the defendant in the parking lot until West Penn police arrived.

They found Lopez to be in possession of a 9 mm handgun, which he had concealed in his waistband. The gun’s remaining ammunition matched the shell casing recovered from the scene, police said.

A preliminary hearing is scheduled for 11:30 a.m. Dec. 16 before District Judge Andrew J. Serina in Orwigsburg.
