A Weatherly man has been charged with attempting to strangle his uncle during a disagreement.
According to the affidavit of probable cause in the case against Shawn Hornberger, which was filed by officer Ashley Harris of the Weatherly Borough Police Department:
Around 8:05 p.m. Aug. 23, Harris was dispatched to a home in the 300 block of First Street for a disturbance.
The uncle was walking from Carbon Street back to First Street and told police he got into a fight with Hornberger, 22, his nephew.
The man said the argument started the night before about him inviting people over without telling Hornberger.
The argument escalated and Hornberger “slammed” the man onto the kitchen table, knocking them both onto the floor, according to court papers.
While on the floor, Hornberger wrapped his arm around the man’s neck, constricting his airway and making it difficult for him to breathe.
During the incident, the man repeatedly said, “I can’t breathe.”
When Hornberger released his arm, the man said he grabbed his cellphone and cigarettes and walked to his sister’s house on Carbon Street.
Hornberger admitted to grabbing the man by the neck. He faces charges of strangulation, simple assault and harassment.
He is currently incarcerated in the Carbon County Correctional Facility in lieu of $20,000, 10% bail, and scheduled to have a preliminary hearing Wednesday before District Judge Eric M. Schrantz of Jim Thorpe.
