Man wanted on home improvement fraud charges
A warrant has been issued for a Northampton County man wanted on charges for home improvement fraud and theft.
According to the affidavit of probable cause filed by Lehigh Township Police Chief Scott Fogel in the case against Brian Fosko:
At 10:15 a.m. April 22, 2022, Fogel met with a woman who reported that she believed she was defrauded by a contractor who she paid to do concrete work for her at her residence in Walnutport.
The woman said that she was looking on an application on her phone for a contractor to do concrete work and received a message from Fosko, 32, of Bath, via NEXT DOOR NEIGHBOR APP, stating that he could do the work.
Fosko sent the woman pictures of work he claimed to have done, as well as provided her with a quote via email from his gmail account.
The quote was for $1,500, and contained a paragraph of information indicating material depth, area to be done and a time frame to complete the work of two to three days, weather permitting.
Also contained in the quote was a requirement to pay 50% of the bill in advance, and the remaining balance paid when work is complete.
The woman gave Fosko a check when he came to her house.
The woman engaged in text messaging back and forth with Fosko from April 12-15, when Fosko asked for an additional $100 for materials, which the woman provided when Fosko came to the house on April 15, for which the woman paid in cash.
Fosko indicated via text he was going to work over the Easter weekend on the project. Over the weekend and into the following week of Easter, the woman received several excuses from Fosko as to why he was not able to start the work.
The woman asked for her money back.
Fosko said he was on his way after picking up materials, and the woman advised him to just start when he arrived.
Fosko never showed up and there was no more correspondence. The last day of correspondence between the woman and Fosko was April 18.
Fosko did not return the deposit, did not start any work, nor drop off any materials.
On April 22, 2022, Fogel attempted to reach out to Fosko via phone and email, but did not receive a response from either.
On May 19, 2022, Fogel called the woman for information regarding the case, and asked if there were any further actions by Fosko.
The woman said she had not received her money back, had not received any further messages from Fosko, and no work was completed.
Fosko is believed to be in the Bath/Nazareth area, possibly operating a Cadillac sedan.
