Police charge man with deceitful business practice

A Northampton County man has been charged with using deceitful business practices.

Lehighton state police say that Michael Smith agreed to pave a homeowner’s driveway but didn’t live up to the terms of the contract. Police say Smith used less material than the contracted stipulated and didn’t complete the job.

StateLine Pavement Maintenance was the name of the company the homeowner contracted with.

When contacted by state police, Smith said that StateLine was not a legitimate business, and was not registered with the state or any other agencies that would go with owning a business. Smith said that he registered a fictitious name, but did not remember who he registered it through, according to police.

The homeowner provided copies of the contract with all information pertaining to the job including dollar amounts each part of the job.

Smith faces charges on seven counts each of deceitful business practice, receives advance payment for services and fails to perform, and theft by deception.

Smith is scheduled to have a preliminary hearing Dec. 7 before District Judge Colleen Mancuso of Brodheadsville.
