Case against Nesquehoning’s ex-chief, officers dismissed

A federal case filed by a Nesquehoning woman against the former borough police chief and other officers has been dismissed.

Shana Ramos, 54, filed the suit on Feb. 3 in U.S. District Court, Scranton, against former police Chief Sean Smith and 10 unnamed officers. In the case, she claimed they violated her civil rights by kicking in her door, and breaking her wrist, on Feb. 9, 2021.

On Wednesday, borough Solicitor Robert Yurchak said that the case has been dismissed.

According to court records, the plaintiff’s counsel filed a stipulation of dismissal on May 16.

“It is hereby stipulated and agreed that the above-entitled action be and it is hereby dismissed without costs against either party,” the stipulation stated.

The case stemmed around an incident where police kicked in her apartment door after she refused to let them in to execute a search warrant.

Ramos claimed she had permanent wrist injuries as a result.
