Carbon County Court - DUI pleas

Twelve defendants in pending driving under the influence cases entered guilty pleas last Friday in Carbon County court.

Judge Joseph J. Matika presided and accepted pleas from the following:

Jannette E. Lewis, 47, of Lehighton, pleaded guilty in two pending cases. She was charged on March 15, 2021, and Sept. 6, 2021, both by Lehighton police for DUI of a controlled substance.

In the first case she was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.

In the second case she was placed in the county’s Restrictive Conditions of Probation program (house arrest), for 60 months with the first 90 days on electronic monitoring, pay a fine of $1,500, license suspended for 18 months and render an additional 75 hours of community service.

Kelly E. Lee Smith, 28, of Weissport, was arrested on April 16 by state police at Lehighton for DUI of alcohol. She also pleaded to possession of drug paraphernalia. She was originally charged with 13 counts.

She was sentenced to serve five days to 60 months in jail, pay a fine of $1,000, supply a DNA sample and render 100 hours of community service. On the drug count she was placed on probation for six months, concurrent with the DUI charge.

She will begin serving the prison term at 4 p.m. on Nov. 4 and serve it on consecutive weekends of two days, two days and one day.

Ryan Anthony Arroyo, 32, of Northampton, was charged on April 15 by state police at Lehighton for DUI of a controlled substance.

He was sentenced to serve 48 hours to six months in prison, pay a fine of $500, license suspension for a year and render 25 hours of community service. He will begin the jail term at 6 p.m. on Nov. 4.

Kevin S. Richards, 40, of Albrightsville, was charged on April 8 by Lehighton police for DUI of alcohol.

Sentencing was deferred so he can obtain a drug and alcohol evaluation.

Scott Michael Albert, 27, of Slatedale, was arrested on Nov. 27, 2021, by state police at Lehighton for DUI of a controlled substance.

He was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, license suspended for a year and render 25 hours of community service. He was given credit for one day already served. He is currently an inmate in the county prison and began the DUI term immediately.

Jonathon Edward Zerby, 31, of Palmerton, was arrested on Oct. 3, 2021, by state police at Lehighton for DUI of alcohol. He was originally charged with 11 counts.

Sentencing was deferred.

Skyler H. Smalley, 25, of Summit Hill, was arrested on Sept. 5, 2018, by Jim Thorpe police for DUI of alcohol.

Sentencing was deferred so he can get a drug and alcohol evaluation.

Dale John Fredericks, 43, of Tamaqua, was arrested on Feb. 10, 2018, by Lehighton police for DUI of a controlled substance.

Sentencing was deferred so he can obtain a drug and alcohol evaluation.

Michelle Lee Warren, 43, of Easton, was arrested on Feb. 13 by state police at Lehighton for DUI of alcohol.

She was sentenced to serve five days to six months in jail, pay a fine of $300, license suspension for a year and render 25 hours of community service.

She began the prison term Friday afternoon.

Austin Burke McConnell, 26, of Richmond, Virginia, was arrested on April 21, 2021, by state police at Lehighton. He was originally charged with 10 counts.

Sentencing was deferred so he can obtain a drug and alcohol evaluation.

Michael Robert Mika, 42, of Lansford, was arrested on Sept. 6, 2021, by Lehighton police for DUI of a controlled substance.

Sentencing was deferred so he can obtain a drug and alcohol evaluation.

Corey John Wensel, 46, of Lehighton, was charged on March 31, 2021, by state police at Lehighton. A charge of endangering the welfare of a child was dropped in a plea deal.

Sentencing was deferred so he can apply for the house arrest program.

Raymond Peguero, 31, of Bronx, New York, was arrested on Nov. 22, 2018, by Weatherly police for DUI of a controlled substance.

Sentencing was deferred so he can obtain a drug and alcohol evaluation.

Sentencings

The following defendants previously entered guilty pleas and were sentenced.

Edward Eugene Whitehead III, 37, of Lehighton, was placed in the house arrest program for 60 months with the first 90 days on electronic monitoring, pay a fine of $1,500, license suspension for 18 months, render 100 hours of community service and supply a DNA sample.

On a driving under suspension charge he was fined $1.000. He was charged on May 21, 2021 by Lehighton police for DUI of a controlled substance.

Lisa Marie Patrick, 41, of Jim Thorpe, was placed in the house arrest program for six months with the first 30 days on electronic monitoring, pay a fine of $750, license suspended for a year and render 25 hours of community service.

On a driving under suspension charge she was fined $200.

She was arrested on Aug. 5, 2021, by state police at Fern Ridge.

Mark L. Flyte, 55, of Effort, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, license suspended for a year and render 25 hours of community service. He was given credit for three days already served.

On a driving under suspension count he was sentenced to serve six to 12 months in jail with credit for 176 days already served, render 25 hours of community service. Having served his minimum in each case he was paroled.

He was charged on July 1, 2021, by state police at Fern Ridge.

Annette Rodriguez, 32, of Allentown, was sentenced to serve 72 hours to 60 months in jail, pay a fine if $1,000, license suspended for 18 months, render 100 hours of community service.

She will begin the jail term at 10 a.m. on Dec. 4. She was charged on June 5, 2021, by state police at Lehighton. There was a juvenile in the vehicle at the time of the stop.

Each defendant sentenced must also pay court costs of over $1,000, pay a $50 per month supervision fee while on probation or parole and follow any recommendation of their drug and alcohol evaluation.
