An Albrightsville man was sentenced to a Carbon County prison term on Thursday on a felony 3 count of criminal trespass and a misdemeanor charge of possession of a controlled substance.
Brian Myers, 56, of Jim Thorpe, was sentenced by Judge Steven R. Serfass to serve 3 to one day less 24 months in prison. The judge rejected a request by Myers and his attorney to impose a probationary sentence.
Myers previously pleaded to the charges.
He was arrested on the trespass charge on Nov. 2, 2021, by Palmerton police for entry to a residence along Lafayette Avenue. In a plea deal, a felony 2 count of burglary was dropped.
The drug arrest occurred on Dec. 12, 2021, by Jim Thorpe police along Centre Avenue when police served a warrant. Police said methamphetamine was found.
The sentence falls in the mitigated range of state sentencing guidelines, which was also part of the plea deal with the DA’s office.
Although the guidelines called for a low-end sentence of between probation and three months, Serfass said a prison term was warranted considering all the facts in the case.
In addition to the prison term, Serfass ordered Myers to make restitution of $1,231.30, which the defendant paid in full; get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, supply a DNA sample, render 100 hours of community service, pay court costs of more than $1,000 and pay a $50 per month supervision fee while on parole.
He will begin the jail term at 9 a.m. on Nov. 10. He was granted work release privileges.
