Man charged with assaulting girlfriend
Charges against a Weatherly man for assaulting and strangling his girlfriend have been bound over to Carbon County court.
According to the affidavit of probable cause filed by officer Joshua Silfee of the Weatherly Police Department in the case against Christopher Kirk:
The woman was hospitalized for a brain bleed from an assault Sept. 26 at Geisinger Wyoming Valley campus, with the woman reporting that she was assaulted in Weatherly.
She had bruising on her arms, legs, back, neck, and face and several chipped teeth. The woman told police she was having a romantic relationship with Kirk, 56.
The two of them went to a bar where a man bought them each a drink, and this enraged Kirk.
They left the bar together and returned to his apartment in Weatherly.
The woman told police Kirk parked his vehicle, punched her in the head and dragged her through the door into the apartment.
Once inside the apartment, Kirk took her cellphone and sat on her chest, pinning her shoulders with his knees and covered her nose and mouth with his hands, causing her to lose consciousness, according to court papers.
The woman said Kirk beat her and she lost consciousness three times.
She then woke up to Kirk on top of her in the bedroom. She saw a handgun on the night table next to the bed and feared for her life. She grabbed the gun, but said she couldn’t fire it.
Kirk wrestled the gun away from her and then held her down and threatened to rape her. He passed out.
The next morning, Kirk took her to her home in Kingston.
He apologized for hitting her and asked if she was going to break up with him.
The woman said yes and ran out of the vehicle.
She then went to the hospital..
Kirk faces charges of aggravated assault, unlawful restraint, terroristic threats, strangulation, simple assault, and recklessly endangering another person.
He was scheduled to have a preliminary hearing Oct. 5 before District Judge Eric M. Schrantz of Jim Thorpe, but waived his right to a hearing.
Kirk is in the Carbon County Correctional Facility in lieu of $100,000 cash bail.
