Carbon County court
A Lansford man, currently serving a county prison term, entered a guilty plea in Carbon County court on Tuesday and was sentenced to a county prison term.
He was one of four defendants in pending criminal cases to enter a guilty plea before President Judge Roger N. Nanovic II.
Lansford incident
Matthew Scott Creveling, 33, pleaded to one count of possession of drug paraphernalia.
He was arrested by Lansford police on Feb. 16, when drugs were found on him.
Creveling is currently an inmate in the county prison serving a sentence of one to two years, less a day, on charges of flight to avoid apprehension and simple assault, in separate incidents. The sentence was imposed in April.
Nanovic sentenced him to serve six to 12 months in prison on the drug count, with the term running concurrent to the sentence he is now serving. He was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment and zero tolerance imposed on drug or alcohol use.
Other pleas
Richard Theriault, 50, of Easton, pleaded to one count of retail theft. He was arrested on Sept. 30, 2021, at Lowe’s store in Mahoning Township.
He and a female companion were observed on surveillance video entering the store and removing various items. He was confronted outside the store by employees but fled in a vehicle. He was later stopped and taken into custody.
He is currently an inmate in the Northampton County prison in Easton serving a sentence on other charges.
Nanovic sentenced him to serve one to 18 months in prison followed by one year of probation. He was also ordered to get a drug and alcohol evaluation, zero tolerance on drug or alcohol use, supply a DNA sample and make restitution to Lowe’s for $879.99.
The term runs concurrent with his Northampton sentence.
Michelle Lynn Malloy, 44, of Slatington, pleaded to one count of possession of drug paraphernalia. She was arrested on June 9 by Mahoning Township police. Police responded to a parking lot near the Big Lots store in the Carbon Plaza Mall for a disturbance involving a male and female.
Malloy was one of the people involved. While investigating the incident police learned that Malloy had an outstanding warrant for her arrest out of Berks County. While being taken into custody on the warrant the drug paraphernalia was found. A pipe used to smoke methamphetamine was found.
Nanovic placed her on probation for six months and ordered her to get a drug and alcohol evaluation and zero tolerance for drug or alcohol use.
Brittany H. Ackley, 30, of Bethlehem, pleaded to one count each of driving under suspension - DUI related and unauthorized use of an automobile. She was arrested on Oct. 24, 2019, by Beltzville Park rangers who conducted a traffic stop for faulty equipment. It was learned at the stop that Ackley did not have permission to have the vehicle she was driving.
Ackley was also scheduled to plea guilty to one count of DUI of a controlled substance. She was arrested on Jan. 27, 2018, by Franklin Township police following a traffic stop along Interchange Road. She refused a test.
The police report indicated she and a passenger admitted smoking methamphetamine a few hours prior to the stop.
However, at the plea hearing she said she was not impaired as stated in the DUI count and denied having an illegal substances in her system at the time of the stop. She then agreed she would not contest the allegations made in the police report.
The DUI proceeding was then continued when she learned the arrest was going to be treated as her third overall DUI conviction which changed the sentencing guidelines from a minimum of 90 days to a minimum of one year in jail.
Nanovic deferred sentencing on the suspension charge and ordered the adult probation office to prepare a presentence investigation report. Ackley will also apply for the house arrest program.
Each defendant sentenced must also pay court costs of over $1,000 and a $50 per month supervision fee while on parole or probation.
