A Lehighton man was sentenced on Thursday in five criminal case in Carbon County court and must enter an inpatient rehabilitation program.
Nathan Miller, 21, was sentenced by President Judge Roger N. Nanovic II on charges of one count each of possession with intent to deliver a controlled substance, a felony; two counts of possession of a controlled substance, driving under the influence and driving under suspension - DUI related; and criminal mischief. He entered pleas to the charges before Nanovic on Monday.
He was sentenced to serve a total of three to one day less 24 months in the county prison. In a plea deal with the district attorney’s office, the court sentenced Miller to a mitigated range on the PWID charge. The jail term will be followed by three years of probation.
Miller was to enter an inpatient rehab program in Quakertown this morning. Nanovic also ruled Miller must successfully complete the program to be paroled. He warned Miller that if he left the program early or was discharged from it for failing to follow the rules, he had to report to the county prison to continue serving his term.
Miller was arrested on the PWID charge on April 4, 2019, by agents of the state Attorney General’s office and members of the county drug task force. Agents arranged for the purchase of methamphetamine from Miller as part of an ongoing investigation.
He was arrested on the DUI and suspension charges on April 13, 2021, by Lehighton police following a traffic stop. The two drug arrests occurred on March 31, 2021, by state police at Lehighton and Feb. 19, 2021, filed by county detectives when he was found with drugs at the county prison. The mischief arrest occurred on May 17, 2021, filed by state police at Lehighton. In that case a felony count of strangulation and a misdemeanor charge of simple assault were dropped in a plea deal with the district attorney’s office.
Nanovic also imposed zero tolerance for drug or alcohol use, ordered he supply a DNA sample, pay a fine of $500 and one-year license suspension on the DUI count, pay a $500 fine on the suspension count, pay court costs of over $1,000, pay a $50 per month supervision fee while on parole, attend and successfully complete an anger management course.
Miller has been an inmate in the county prison on the charges and was given credit for 203 days already served.
DUI
Thomas Alton Smith, 43, of Whitehall, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, license suspended for a year, pay court costs of over $1,000 and pay a $50 per month supervision fee while on parole.
He arrested on Feb. 6, 2021, by state police at Lehighton for DUI of a controlled substance. He previously entered a plea to the charge.
He was given credit for three days already served and parole.
