Carbon County court

A Schuylkill County man was sentenced to jail terms on Thursday in Carbon County court on a drug count and driving under the influence charge.

He was one of seven defendants to be sentenced during DUI court by President Judge Roger N. Nanovic II.

Mahoning incidents

Allen Bauder Jr., 37, of Andreas, was sentenced to serve one to one day less 24 months in prison on a charge of possession of a controlled substance - methamphetamine and marijuana, and 72 hours to six months in jail on a DUI charge. The terms run concurrently.

He was arrested on the DUI and drug counts on Jan. 13, 2021, by state police at Lehighton in Mahoning Township.

Before the sentencing Bauder entered a guilty plea to one count of defiant trespass. He was arrested on Feb. 6, 2020, by Mahoning Township police for entering the Walmart store after previously being given written notice he was not allowed on the Walmart property. On the trespass charge he was placed on probation for a year, concurrent with the other charges.

In addition in the DUI case Bauder was fined $1,000 and his license suspended for a year and zero tolerance imposed on drug or alcohol use.

He was given credit for four days already served on the charges and will begin serving the remainder of the prison term at 5 p.m. on Aug. 26.

Other cases

The following were sentenced on DUI counts. They previously entered guilty pleas to the charges.

Joshua D. Smith, 41, of Lehighton, was sentenced to serve 90 days to five years in jail, pay a fine of $1,500 and license suspended for 18 months. He must also supply a DNA sample. On a charge of possession of a small amount of marijuana, he was fined $50.

He was arrested On Oct. 14, 2020, by state police at Lehighton for DUI of a controlled substance in East Penn Township.

He will begin serving the prison term on Sept. 2 at 9 a.m. and serve it on consecutive two-day weekends.

Cheffie Melhem, 49, of Easton, was placed on probation for six months and ordered to pay a fine of $300.

A first offense, she was arrested on Aug. 29, 2019, by Lehighton police.

Catherine Christina McDonnell, 41, of Blakeslee, was sentenced to serve 90 days to five years in prison, pay a fine of $1,500 and license suspended for 18 months. She must also supply a DNA sample.

She was arrested on June 29, 2020, by state police at Lehighton.

She will begin serving the prison term on Aug. 19 at 5 p.m. and serve it on consecutive two-day weekends. She was given credit for eight days already served.

Kenneth George Hudock, 55, of Lehighton, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and license suspended for a year.

He was arrested on July 21, 2021, by state police at Lehighton.

He began the jail term immediately.

Robert Adam Fehr, 26, of Bath, Northampton County, was placed on probation for six months and ordered to pay a fine of $300.

He was arrested on March 13, 2021, by state police at Lehighton.

Michael J. Horwath, 40, of Nuremberg, Schuylkill County, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and license suspended for a year.

He is an inmate in the Schuylkill County prison serving a three to nine month sentence for a probation violation. He told the court his minimum is up Aug. 19, but applied for parole.

Each defendant must also pay court costs of over $1,000 and a $50 per month supervision fee while on parole or probation.
