Lansford woman given jail time, house arrest, in gun theft incident
A Lansford woman was placed in the county’s Restrictive Conditions of Probation program (house arrest) on Friday but must also spend time in prison for the illegal sale of firearms, her father said she sold without his permission.
Geraldine A. Blum, 53, appeared before President Judge Roger N. Nanovic II on a charge of making materially false or oral statements.
She was charged by Lansford police with selling guns that belonged to her father without his permission to sell them.
There was a dispute as to how many guns were involved. The father claimed that was over 70 but Blum said the number was closer to 35.
Nanovic noted he had a hearing on the restitution question concerning the value and number of guns involved. He said two gun dealers who purchased weapons from Blum could not testify for certain guns the father said were his, were ones they purchased from the defendant. The father had claimed the value of the guns was $70,000, but testimony at the hearing could not establish, as a matter of law, what the value was of the guns.
Nanovic said, “There is a whole fabricated story here.”
He said Blum first told authorities she had permission to sell the guns then later admitted she didn’t have permission. She then questioned the number of weapons involved.
Nanovic said the commonwealth submitted a restitution figure of $9,025 for the guns sold but has little proof to justify that figure. He said because the figures presented do not meet the requirement of the restitution guidelines he would not order any restitution. He said if the father wants to pursue the higher figure he can do so in civil court.
Nanovic placed Blum in the RCP program for five years with the first 90 days spent in the county prison followed by nine months on home electronic monitoring. She must also get a drug and alcohol evaluation and follow any recommendation for treatment, pay court costs of over $1,000 and pay a $50 per month supervision fee while in the program.
She was given credit for 29 days already spent in jail on the charge. She will begin serving the prison term at 1 p.m. on May 2.
