Carbon County court — ARD
A Bethlehem man, charged with indecent assault and harassment, was placed in the Carbon County’s Accelerated Rehabilitation Disposition probation program this week.
He was one of three in pending criminals cases to be placed in the program by President Judge Roger N. Nanovic II.
If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.
Nesquehoning incident
Edel Abalberto Aldana Oreliana, 38, was placed for 18 months for an incident reported on April 9, 2021, to Nesquehoning police.
The affidavit of probable cause states that police received a complaint about 9:30 p.m. on April 9 from a male who said his girlfriend has been indecently touched at Rosetta’s Pizza, at 209 W. Catawissa St., by the then owner of the business, Oreliana.
The female told officers that Oreliana had inappropriate contact with her at the business when he gripped her butt and lifted her up. The report indicated this happened twice, once inside the business and the second time outside in the back of the business.
Oreliana submitted to an interview with police and admitted coming in contact with the female and hugging her on two separate occasions. He admitted picking her up and hugging her, that he did have his hands interlaced and that they were under her butt.
Police also said they viewed video footage of a camera set up outside in the back of the business and it showed Oreliana hugging the female and picking her up. He could be seen placing the female back down and putting his face into her neck.
Oreliana was assessed $650 for the cost of the program and ordered to submit to a sexual offenders evaluation, and get a drug and alcohol evaluation and follow any recommendation for treatment.
Other cases
Brandon D. Dopira, 28, of Summit Hill, was placed for six months on a resisting arrest charge. He was arrested on July 15, 2021, by Summit Hill police. He was assessed $450 and ordered to get a drug and alcohol evaluation.
Ryan Michael Yacone, 22, of Kunkletown, was placed for a year on a driving under the influence of a controlled substance charge. He was arrested on Feb. 18, 2021, by state police at Lehighton. A test also revealed a 0.20 BAC.
He was assessed $600 and his license was suspended for 60 days.
Each defendant must also pay court costs of over $1,000 and a $50 per month supervision fee while in the program.
