Man admits to indecent assault count

A man entered a guilty plea on Thursday in Carbon County court to a indecent assault charge.

Gabriel P. Leshko, 45, currently an inmate in the state correctional institution at Dallas, Luzerne County, entered his plea before Judge Joseph J. Matika, via video conference call from the prison. He listed the prison as his address.

At the start of the proceeding Matika told Leshko and his defense counsel, Chief Public Defender Paul J. Levy, that he would not go along with the plea bargain which called for a concurrent sentence be imposed with the one the defendant is now serving. In a plea deal, a felony 1, charge of unlawful contact with a minor - sexual offenses, was dropped by the DA’s office.

Leshko told the judge he would continue with the plea knowing any sentence imposed by the court would be consecutive to what he is currently serving.

Matika said he wouldn’t go along with the plea deal as presented because of Leshko’s extensive prior criminal record for sexual assault type charges.

In the standard range of state sentencing guidelines, Leshko was told he faces a minimum state prison term of somewhere between 24 to 30 months up to five years.

Sentencing was deferred and Matika ordered the adult probation office to prepare a presentence investigation report.
