Man sentenced in case dating back over 13 years

A man was sentenced to a prison term on Thursday in a sexual assault case which dates back over 13 years ago.

David Jones, 47, who lists his address as the county prison, was sentenced by President Judge Roger N. Nanovic II to serve nine to one day less 24 months in prison on a charge of indecent assault, in a case he has already served 10 years in a state prison.

He won’t be spending any more time in jail, however, because he has served 904 days in the county prison on the case and has already reached his maximum term of two years. He previously pleaded to the charge in a plea deal with the district attorney’s office.

In the original case he was released from prison after serving the maximum term and was living in the Pittsburgh area when the second victim, the younger of the two, came forward and demanded justice in his case.

The victim was 7 years old at the time, but is now 18. At the time of the first case she was ruled not competent to testify because of her age but came forward in March 2019 to say she was now competent to testify. The other victim in the case was then an 11-year-old girl.

In that case, Jones pleaded guilty to aggravated indecent assault of a person less than 13 years old and was sentenced in 2010 to serve 29 months to 10 years in prison. He ended up serving the full 10 years.

In 2008, both victims were examined by a St. Luke’s physician and it was determined the sexual assault had been occurring for about two years.

Police said Jones threatened the girls that he would harm them and their mother if they got pregnant or told anyone about the incidents.

In the new case, Jones was charged with rape of a child, rape by forcible compulsion, aggravated indecent assault of a child, involuntary deviate sexual intercourse by forcible compulsion, statutory sexual assault, sexual assault and aggravated indecent assault without consent. The indecent assault charge was added to the original complaint.

Defense Attorney Michael P. Goth, court appointed, asked Nanovic to impose the standard range sentence of nine to 24 months, noting his client has already served almost 30 months on the new set of charges.

District Attorney Michael S. Greek agreed to adding the misdemeanor count and having Jones plead to it, citing the fact the defendant had already served 10 years in a state prison in the same case.

On Thursday, Nanovic told Jones he would have imposed a more severe penalty for such a charge but agreed that he had served a sufficient amount of time in the case. Nanovic said had the case originally gone forward with the two victims, he felt the same sentence of 29 months to 10 years would have been imposed.

Jones said when he is released he will return to the Pittsburgh area where he was residing when the new set of charges were filed. It was noted at the time of the second arrest Jones was complying with all conditions of Megan’s Law relative to registration requirements.

Nanovic also ordered Jones to supply a DNA sample, have no contact with the victim and his lifetime registration as a sexual offender continues and he must follow all registration and other conditions associated with Megan’s Law.
