Carbon County court — ARD
Nine first-time offenders were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Friday by Judge Steven R. Serfass.
If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.
All were placed for a year, unless otherwise noted, and ordered to render 50 hours of community service, pay court costs of about $1,000, pay a $50 per month supervision fee while in the program and follow any recommendation of their drug and alcohol evaluation.
Yamilson Cruz, 22, of Bronx, New York, was arrested on July 30, 2020, by state police at Lehighton, in the main parking lot of Beltzville State Park in Franklin Township, for DUI of a controlled substance.
He was assessed $650 for the cost of the program and his license was suspended for 60 days. His term was reduced to six months.
Amara Ann Hittinger, 27, of Walnutport, was arrested on Jan. 9 by state police at Lehighton.
She was assessed $450.
Claudia Howard, 34, of Newark, New Jersey, was arrested on July 4, 2019, along Interchange Road in Lehighton by state police at Lehighton for DUI of a controlled substance.
She was assessed $600 and her license was suspended for 60 days.
Coty Lee Parsons, 27, of Palmerton, was arrested on Jan. 30 by state police at Lehighton along Hahns Dairy Road in Lower Towamensing Township. A test showed a 0.17 BAC.
He was assessed $550 and his license was suspended for 60 days.
Serece M. Yanick, 35, of Lehighton, was arrested on Jan. 21 by state police at Lehighton along Route 248 at Bowmanstown, for DUI of a controlled substance.
She was assessed $600 and her license was suspended for 60 days.
Jasmar Daron Hayward, 28, of Columbia, North Carolina, was arrested on Jan. 12 by state police at Lehighton along Interchange Road in Towamensing Township, for DUI of a controlled substance. He was also charged with firearm not to be carried without a license when troopers found a HiPoint C9 9 mm gun in his vehicle. His placement was done via Zoom from his home.
He was assessed $600 and his license was suspended for 60 days.
Jonathan Christopher Person, 20, of Walnutport, was arrested on July 4, 2020, by state police at Lehighton, along Route 443 in Lehighton, for DUI of a controlled substance.
He was assessed $650 and his license was suspended for 60 days.
Sandee Jane Albaugh, 51, of Albrightsville, was arrested on Jan. 6 by state police at Fern Ridge along Route 534 in Kidder Township. A test revealed a 0.10 BAC.
She was assessed $500 and her license was suspended for 30 days.
Dar Plasencia, 22, of Hazleton, was arrested on Sept. 15, 2020, along Interstate 80 in Kidder Township, by state police at Fern Ridge.
He was assessed $450 and his license was suspended for 60 days.
