Man admits to indecent assault in case dating back to 2008

A man admitted in Carbon County court on Monday afternoon to one count of indecent assault in a case that dates back to 2008, in which he has already served 10 years in the same case for a second victim.

David Jones, 47, who lists his address as the county prison, pleaded to the charge before President Judge Roger N. Nanovic. The victim was 7 years old at the time, but is now 18. At the time of the first case she was ruled not competent to testify because of her age but came forward in March 2019 to say she was now competent to testify. The other victim in the case was then an 11-year-old girl.

In that case, Jones pleaded guilty to aggravated indecent assault of a person less than 13 years old and was sentenced in 2010 to serve 29 months to 10 years in prison. He ended up serving the full 10 years, according to District Attorney Michael S. Greek.

In 2008, both victims were examined by a St. Luke’s physician and it was determined the sexual assault had been occurring for about two years.

Police said Jones threatened the girls that he would harm them and their mother if they got pregnant or told anyone about the incidents.

In the new case, Jones was charged with rape of a child, rape by forcible compulsion, aggravated indecent assault of a child, involuntary deviate sexual intercourse by forcible compulsion, statutory sexual assault, sexual assault and aggravated indecent assault without consent. The charge he pleaded to was added to the original complaint. All the other charges were dropped in a plea deal.

Nanovic accepted the plea but deferred sentencing, stating the case falls under the provisions of Megan’s Law. Jones will have to submit to an evaluation by the state sexual offenders assessment board.
