Carbon County court
A Lehigh County woman was sentenced to a county prison term Monday afternoon in Carbon County court after pleading guilty in two pending cases, including a drug dealing charge.
She was one of four defendants in pending criminal cases to enter a plea before President Judge Roger N. Nanovic II.
Vehicle stop
Brittaney Marie Weed, 26, of Allentown, pleaded to one count of possession with intent to deliver a controlled substance following a vehicle stop by Jim Thorpe police on Dec. 27, 2019. At the stop she told officers that she did not have any identification on her and gave police a false name and birth date.
It was later learned that the name and birth date belonged to a onetime friend of hers who was picked up on a warrant for failure to appear for a preliminary hearing on the charge.
She was taken to the county prison but argued she was not involved in any vehicle stop on the date and time taken. Police compared her with a photo taken of Weed when she was brought to the prison by Jim Thorpe police. Police then realized they had the wrong person.
Weed, who is an inmate in the Northampton County prison, told Nanovic, via video conference, that the day she was bailed out of the Carbon prison her mother signed the bail piece knowing who she really was. She also claimed the victim of her false identification was with her mother at the time. The mother was charged for her part in the deception and is serving a probation term.
She pleaded in a second case to default in required appearance and obstruction to the administration of law for giving a false ID and failure to appear for court proceedings. In the drug case she also pleaded to false identification to law enforcement.
Weed said she was on parole in Northampton County on a sentence of three to 15 months and is awaiting a new sentencing for a parole violation.
She admitted to a long-term drug addiction problem.
On the default and obstruction charges, Nanovic sentenced her to serve six to one day less 24 months. On the drug count she was sentenced to serve one to one day less 24 months in jail, concurrent with the first case, and on the false ID charge, one year probation, consecutive to the other charges.
She was also ordered to get a drug and alcohol evaluation, supply a DNA sample and attempt to get her GED diploma.
Other pleas
Brittaney Michelle Vincent, 26, of Saylorsburg, pleaded to one count of DUI. She was arrested on Feb. 21, 2020, along Interchange Road in Franklin Township by state police at Lehighton.
A test showed the presence of a controlled substance.
Sentencing was deferred so Vincent can obtain a drug and alcohol evaluation.
Christopher Moser, 48, of Allentown, pleaded guilty in two pending cases.
He pleaded to one count of DUI for an incident on Nov. 19, 2019, filed by state police at Lehighton after a vehicle stop. He refused testing.
He also pleaded to harassment, as a summary offense, for an incident on Aug. 20, 2019, filed by Franklin Township police stemming from a domestic incident. In exchange for the plea, a felony 2 count of strangulation and a misdemeanor 2 count of simple assault was dropped by the district attorney’s office.
Sentencing on the DUI charge was deferred so Moser can obtain a drug and alcohol evaluation.
On the summary offense of harassment he was fined $300.
Thomas Joseph Baldini, 30, of Lansford, pleaded to a summary offense of operating a vehicle without required financial responsibility (no insurance). In exchange of the plea a misdemeanor charge of possession of drug paraphernalia and two summary offenses, driving without a license and driving while operating privileges are revoked or suspended, were dropped.
He was arrested on June 25, 2020, by Lansford police following a traffic stop.
He was fined $25.
Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee if on probation or parole.
