West Penn reaches settlement agreement

A settlement was reached between West Penn Township and other parties in regard to ongoing water extraction ordinances and issues. Details were not available Monday night.

“There have been discussions regarding settlement with the Fort Franklin facility/ Tower Springs LLC with respect to zoning enforcement notices that have previously been issued by the township,” said West Penn solicitor Paul Datte.

“There have been a number of discussions between the township, representatives for the Knoedlers and Tower Springs. There has been further investigation by the township on the issues that appeared in those enforcement notices, and the parties have reached a settlement agreement, which has been reviewed by you, the board of supervisors and before you this evening.”

The board of supervisors made a motion to adopt the settlement agreement with the condition that they receive signed agreement from the other parties to the agreement.

“I want to state for the public, that one of the provisions in the settlement agreement is an understanding that there would be no communications about the settlement agreement, unless they were approved by all parties to the settlement agreement,” Datte said.

Datte said that a joint statement is anticipated by both the township and the other parties to the agreement.

However, the statement was not released on Monday.

“And because of the terms of the settlement agreement itself, we really can’t comment on the settlement agreement until that joint statement is issued,” Datte added.

Datte said the settlement agreement will be made available to the public, assuming that it’ll be signed by all of the parties - but there wouldn’t be any changes to the settlement agreement.
