Credit defaults

The following actions were filed by credit card companies, or their collection agencies, for alleged defaults on credit card/loan accounts.

Mortgage foreclosure

Wilmington Savings Fund Society, Box 2741, Seal Beach, California, filed a mortgage foreclosure action against Howard W. David, as the administrator of the estate of Ruthann David, over property at 906 A Holiday Drive, Albrightsville, alleging default on a loan. Sought is $21,619.93 and continuing interest.

Loan default

Goodman Sachs Bank USA, c/o 3220 Tillman Drive, Bensalem, filed a civil action against John Kupec, 116 E. Walter St., Summit Hill, alleging a default on a loan agreement. Sought is $13,960.49 plus interest, costs and fees.

Agreement defaults

First Commonwealth Federal Credit Union, 6126 Hamilton Blvd., Allentown, filed a civil action against Danton R. Guinther, 22 W. Holland St., Summit Hill, alleging a default on a retail installment sale contract. Sought is $8,528.94 plus interest, costs and fees.

First Commonwealth filed an action against Melissa Ann Leslie, 242 W. Columbus Ave., Nesquehoning, and Keith P. Gogal, 23 E. Railroad St., Nesquehoning, alleging they defaulted on a loan and security agreement for the purchase of a motor vehicle. Sought is $3,729.50 plus interest, costs and fees.

Slip and fall suits

Brandon and Stacey Merz, 97 Princeton Ave., Palmerton, filed a civil action against Matthew W. and Kelley Guedes, 435 Princeton Ave., Palmerton, seeking damages for a slip and fall incident.

The suit states on Feb. 1, 2019, Brandon Mertz, while employed by the U.S. Postal Service as a mail carrier, was on the defendant’s property to deliver mail. The suit states Mertz entered the property on a sidewalk, negotiated a set of concrete stairs and approached the mailbox when he encountered water and/or ice that had accumulated due to improper drainage of water from a gutter located about 3-5 feet above the top of the doorway. He was caused to slip and fall and sustained injuries which are detailed in the suit.

Negligence is alleged against the defendants and sought are damages in excess of $50,000.

Jeffrey and Marilen Reed, 90 Saginaw Drive, Jim Thorpe, filed a civil complaint against 903 Scoops LLC, 1398 Route 903, Jim Thorpe, seeking damages for a fall.

The suit states on Sept. 13, 2019, Jeffrey Reed was at the Scoops premises at 1398 Route 903, Suite 2, Jim Thorpe, and was exiting the store when “suddenly and without warning, as a direct result of a defective and/or dangerous condition, more specifically, poor visibility and a poorly trimmed tree extending into the walkway” caused the plaintiff to trip and fall on a wooden post protruding from the platform outside the doorway.

Negligence is alleged for injuries sustained and detailed in the suit. Sought are damages excess of $50,000.
