Carbon County court — guilty pleas
A Carbon County woman admitted to an assault count and resisting arrest in the county court on Tuesday.
She was one of eight defendants in pending criminal cases to enter a guilty plea before Judge Steven R. Serfass.
Thorpe incident
Sami Jo Margaret Green, 29, of Jim Thorpe, pleaded to simple assault and resisting arrest for an incident on Dec. 5, 2020, in Jim Thorpe. Police responded to a report of an assault and found Green. She was highly intoxicated and struggled with officers, who had to use substantial force to take her into custody.
She entered her plea via video conference from the county prison, where she is being held on other criminal charges.
Serfass sentenced her to serve two to one day less 24 months in prison on each count with the terms running concurrently. She was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, supply a DNA sample, render 100 hours of community service and have no contact with the victim.
On a summary harassment charge which she also pleaded to, she was fined $300.
Other pleas
Mark Ryan Ruch, 30, of Lehighton, pleaded to one count of tampering/fabricating evidence, a misdemeanor 2. In exchange for the plea, two felony 2 counts of false/fraud/insurance fraud and insurance fraud were dropped in a plea deal with the district attorney’s office.
Ruch was charge by state police at Hazleton for an incident on July 20, 2020, in Penn Forest Township. Troopers responded to a report of a fire. The investigation revealed that Ruch’s then girlfriend had set some items on fire in a home. Ruch then filed a claim for damages, knowing the fire had been deliberately set.
Serfass placed him on probation for a year and ordered him to make restitution of $3,627.97, a half-share of the total due, to the insurance carrier and to render 50 hours of community service.
Tanya M. Hosier, 41, of Lehighton, pleaded to one count of tampering/fabricating evidence.
She was arrested on Dec. 25, 2020. Lehighton police responded to room 33 at the Mahoning Inn along Blakeslee Boulevard for a drug report. On scene officers knocked on the door but Hosier did not open it. An officer observed through a window Hosier in the bathroom dropping baggies of suspected drugs into the toilet. Officers had to force open the door, but Hosier had already flushed the items.
Her plea was done via video conference from the county prison where she is being held on parole violation.
Serfass sentenced her to time-served (53 days) to 18 months in prison and ordered her to render 75 hours of community service when paroled and make restitution of $95 to the inn for damages to the door.
Dale A. Stevens, 59, of Weissport, pleaded to one count of hindering apprehension.
She was arrested for an incident on July 29, 2020, when Weissport police went to her residence looking for her son, who had a warrant for his arrest. She denied he was at the home but he was apprehended exiting to the rear. Police said she let her son stay at the home knowing there was a warrant for his arrest.
Sentencing was deferred.
Stacy Marie Kilpatrick, 35, of Jim Thorpe, pleaded to one count of simple assault.
She was arrested on Aug. 10, 2020, by Jim Thorpe, after she went to a home along Center Avenue and assaulted a man who answered the door. She then fled the scene but was later apprehended.
She entered the plea via video from the county prison where she is waiting to be transferred to a state prison. In November 2020, President Judge Roger N. Nanovic II sentenced her to serve 12 to 36 months in a state prison on a possession with intent to deliver a controlled substance charge. Her transfer to the state prison has been delayed due to COVID-19 issues.
Serfass sentenced to her serve six to 24 months in a state prison and ordered her to have no contact with the victim. The term runs concurrent with the drug case.
David Bonilla, 44, of Allentown, pleaded to a summary offense of disorderly conduct with a charge of false identification to law enforcement dropped in a plea deal with the DA’s office. He was arrested on Nov. 12, 2017, by Lehighton police.
Serfass imposed a fine of $300.
DUI cases
Kimberly Cunningham, 55, of White Haven, pleaded to one count of driving under the influence. She was arrested on June 28, 2020, by state police at Fern Ridge after being involved in a crash in Penn Forest Township.
Serfass sentenced her to serve 48 hours to six months in prison, pay a fine of $500, one-year license suspension and render 25 hours of community service.
She will begin the jail term at 9 a.m. on March 6.
Cory John Wensel, 44, of Palmerton, pleaded to one count of DUI of a controlled substance. He was arrested on Feb. 27, 2019, by state police at Lehighton.
Sentencing was deferred so he can obtain a comprehensive drug and alcohol evaluation.
All defendants sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
