Carbon man given prison term after admitting assaulting his wife

A Carbon County man was sentenced to a county prison term on Tuesday after admitting assaulting his wife in a domestic dispute.

Dan Rodriguez, 33, of Nesquehoning, appeared before President Judge Roger N. Nanovic II to plea to one count each of recklessly endangering another person and a summary offense of harassment. In exchange for the pleas the district attorney’s office dropped two counts of aggravated assault, criminal attempt, simple assault, terroristic threats and strangulation.

Rodriguez was arrested on Sept. 5, 2019, at his home along Holland Street by Nesquehoning police.

According to an affidavit filed by officer Carl Breiner, a woman who appeared to be in distress came to the police station door. He helped her into the station and she reported that Rodriguez attacked her. Marks on her neck were visible and she had an ankle injury.

The victim told police Rodriguez took their two children and left in a vehicle and she walked to the police station.

She also told police Rodriguez strangled her at knife point, assaulted her and then threatened to kill her. At this time, she jumped from the third-story window of her home, because she feared for her life. She sustained a fracture to her ankle in the jump.

Defense Attorney Bernard J. Brown told the court since the incident his client successfully completed an anger management course.

Rodriguez said he had become depressed, which fueled his actions. He has since addressed mental health issues. He and his wife are still together.

Nanovic asked Assistant District Attorney Robert Frycklund if his office was seeking a deadly weapon enhancement sentence because a knife was used in the incident. Frycklund said no.

Nanovic then sentenced Rodriguez to serve one to one day less 24 months in prison and ordered he get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, attend anger management course (but will accept proof of that if he had already completed it), and supply a DNA sample.

On the summary harassment count he was fined $300.

He will begin the jail term at 6 p.m. on Feb. 12 and serve it on consecutive two-day weekends.
