Jim Thorpe woman sent to state prison on drug charges
A Jim Thorpe woman was sentenced to a state prison term after previously pleading guilty in three pending cases to a drug charge and other counts.
Stacy Kilpatrick, 34, was sentenced by President Judge Roger N. Nanovic II to serve a total of 12 to 36 months in a state correctional institution on a charge of possession with intent to deliver a controlled substance.
She was also sentenced on charges of flight to avoid apprehension and possession of drug paraphernalia.
She was arrested on the possession charge on Sept. 11, 2019, by state police at Fern Ridge following a traffic stop in Penn Forest Township. Kilpatrick was a passenger in the vehicle and was found with 114 bags of heroin. The other drug arrest occurred on Oct. 2, 2019, also following a traffic stop by state police at Fern Ridge. She was a passenger in the vehicle and found with methamphetamine. The flight to avoid apprehension occurred on Dec. 13, 2019, filed by state police at Fern Ridge. Troopers went to a residence in Penn Forest Township to serve a warrant. She fled the home on foot but was located a short time later and taken into custody.
Kilpatrich admitted to a history of drug addiction problems but claimed she was drug free since last December. However, Nanovic noted an adult probation office report indicated she tested positive for methamphetamine in June. She then claimed someone must have put the drug in something she drank or ate.
Nanovic also noted the intent to deliver charge is her second conviction of that charge and that she had a pending count in Monroe County. He said the state system will best help her with her drug addiction.
In addition to the prison term, Nanovic ordered her to get a drug and alcohol evaluation and follow any recommendation for treatment, supply a DNA sample and pay court costs of about $1,000.
She was given credit for 150 days already served. She will begin the prison term at 6 p.m. on Nov. 13.
