Carbon County court

A Carbon County woman admitted to failing to appear at the county prison to start serving a weekend sentence.

She was one of nine defendants in pending criminal cases to enter a plea on Monday before Judge Steven R. Serfass.

Stacey Lynn Miller, 32, of Lehighton, pleaded to two counts of default in required appearance.

In May 2019, she was sentenced by Serfass in two cases to serve six to 60 months in prison on each case with the terms running concurrently. She was to serve the jail time on consecutive weekends beginning May 19. She failed to appear for her first weekend.

She entered the plea via video conference from the county jail where she is serving the six to 60 months term.

Serfass placed her on probation for 24 months on each count, running consecutively to each other and the jail term. She was also ordered to render a total of 200 hours when paroled.

Other pleas

Kenneth James Berger, 44, of Albrightsville, pleaded to one count of harassment, as a summary offense. He was arrested on April 3 by state police at Fern Ridge at a residence along Byron Trail in Penn Forest Township. Troopers responded to a reported domestic incident. In exchange for the plea, the district attorney’s office dropped a felony 2 count of strangulation and one misdemeanor 2 simple assault charge. It was noted the victim agreed to the plea deal.

Serfass imposed a fine of $300.

John R. Muffley Jr., 40, of Lehighton, pleaded to one count of false identification to law enforcement. He was arrested on June 12, 2019, by Lehighton police following a traffic stop along Route 443. He was a passenger in the vehicle and methamphetamine was found. A charge of possession of a controlled substance was dropped in a plea deal.

He was placed on probation for a year and ordered to render 50 hours of community service.

Robert Lee Clifford III, 26, of Lansford, pleaded to one count of false identification to law enforcement. He was arrested on July 8 by Nesquehoning police following a traffic stop along Route 54. Police responded to a crash report in which Clifford’s vehicle struck a utility pole. He initially said the vehicle had been stolen, which was false.

He was placed on probation for a year and ordered to render 50 hours of community service and make restitution to PPL for the pole damages of $3,671.37.

Timothy Harold Solowej, 45, of Lehighton, pleaded to one count each of resisting arrest and criminal trespass. In exchange for the plea, a felony 1 count of burglary was dropped in a plea deal.

He was arrested on Nov. 18, 2019, by state police at Fern Ridge for an incident along Smith Road in Penn Forest Township. Troopers responded to a suspicious person report and learned Solowej was involved in an incident at a neighbor’s residence.

On the resisting charge Serfass sentenced him to time-served (12 days) to 18 months in jail and ordered he render 75 hours of community service, make restitution for damages of $3,453.73, zero tolerance for drug or alcohol use and continuing his present counseling sessions.

On the trespass count, a summary, he was fined $300.

Joseph Bassetti Jr., 36, of Albrightsville, pleaded to one count of driving under the influence of a controlled substance. He was arrested on Nov. 15, 2019, by state police at Fern Ridge along Route 903 in Penn Forest Township. Troopers indicated methamphetamine was involved.

Sentencing was deferred.

John M. Egan, 43, of Albrightsville, pleaded to one count of criminal mischief. In exchange for the plea a felony 3 count of terroristic threats was dropped in a plea bargain.

He was arrested on Sept. 26 by state police at Fern Ridge along Nash Trail in Penn Forest Township. Troopers responded to a domestic incident involving the defendant smashing items in a residence.

He was sentenced to time-served (12 days) to one year in jail and ordered to get a drug and alcohol evaluation, render 50 hours of community service, pay restitution for damages of $2,985 and have no contact with the victim.

Robert T. Holman, 70, of Albrightsville, pleaded to one count of persistent disorderly conduct for an incident on Sept. 23 along Old Stage Road in Penn Forest Township. In exchange for the plea a charge of corruption of minors was dropped.

State police at Fern Ridge responded to the area and was told by a woman that she and her six children were walking by Holman’s residence when he began yelling at her to pull up her shirt and expose her breasts. The children included four females, ages 5 to 15.

Holman said he apologized to the victim for his actions.

He was placed on probation for a year and ordered to have no contact with the victim.

Carol Cain, 58, of Brockton, formerly of Lehighton, pleaded to one count of persistent disorderly conduct. She was arrested on March 26, 2018, by Lehighton police at the Garden Gypsy Hill apartments for causing a disturbance. Her unruly behavior continued at the police station.

Serfass placed her on probation for six months and ordered her to get a drug and alcohol evaluation.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
