Loan defaults
American Heritage Federal Credit Union, 2060 Red Lion Road, Philadelphia, filed an action against Michael P. Torbey, 63 Lower Nis Hollow Drive, Lehighton, alleging he defaulted on a retail installment contract and security agreement (loan). Sought is $7,000.40 plus interest, costs and fees.
Ally Bank, P.O. Box 130424, Roseville, Minnesota, filed an action against David L. Knauft Jr ., 181 W. 13th St., Jim Thorpe, alleging he defaulted on a retail installment sale contract (loan). Sought is $42,567.75; or possession of a 2018 Nissan Titan vehicle.
Ford Motor Credit Company, 1335 S. Clearview Ave., Mesa, Arizona, filed an action against Thomas W. MacDonald, 403 Lehigh Ave., Palmerton, alleging he defaulted on a loan for a motor vehicle, a 2014 Ford Escape. Sought is $19,302.69 plus interest, costs and fees.
Mortgage foreclosures
The following actions were filed as mortgage foreclosures for alleged defaults on loans.
U.S. Bank Trust National Association, 425 S. Financial Place, Chicago. Illinois, filed an action against Kimberly A. and Ricky L. Kistler, aka Ricky L. Kistler Sr., 493 Fairyland Road, Lehighton, over property at that address. Sought is $156,980.54 and continuing interest.
Wells Fargo Bank, 1 Mortgage Way, Mount Laurel, New Jersey, filed an action against Matthew J. Fassl, 12 Weeping Willow Lane, Lehighton, over property at that address. Sought is 176,421.14 plus continuing interest.
County sued
Carbon County has been named defendant in a slip and fall suit. The plaintiff is Jill Otthofer, 5912 Pine St., East Petersburg, Lancaster County.
The suit states on Sept. 7, 2019, the plaintiff was walking on the sidewalk of the Jim Thorpe Visitor Information Center property at 2 Susquehanna St., Jim Thorpe, when she sustained serious injures, detailed in the suit, when she “suddenly was caused to slip, trip, stumble and/or fall on the broken, defective, buckled and/or uneven sidewalk.”
Negligence is alleged against the defendant and sought are damages in excess of “an amount in excess of the jurisdictional amount requiring compulsory arbitration.”
