Carbon County court — ARD
Four first-time offenders in the criminal justice system were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Thursday by President Judge Roger N. Nanovic II.
If a person successfully completes all conditions of the program, their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.
Placed were the following:
Craig Patrick Filer,
32, of Nesquehoning, was placed for two years on charges of terroristic threats, recklessly endangering another person and two counts of simple assault. He was arrested on April 12 by Nesquehoning police for an incident along Industrial Road. Initial reports indicated there was a firearm involved.
He was assessed $450 for the cost of the program and ordered to get a mental health evaluation and follow any recommendation for treatment.
Michelle Ann Klotz,
48, of Lehighton, was placed for two years on two felony counts of possession with intent to deliver a controlled substance and two counts of possession of a controlled substance, misdemeanors. She was arrested on May 23, 2016, by agents of the state attorney general’s office at a residence along Evergreen Road. The arrest report indicated methamphetamine and cocaine was found. The case has a long history with a total of 19 continuances filed in the matter.
She was assessed $650 and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance for drug or also use and render 50 hours of community service.
Jason Lutz,
37, of Saint Clair, Schuylkill County, was placed for a year on a DUI charge. He was arrested on Aug. 25, 2018, along Mahoning Mountain Road by Mahoning Township police. A test revealed a 0.19 BAC.
He was assessed $650, his license was suspended for 60 days and he must follow any recommendation of his drug and alcohol evaluation.
Heather Verona Mae Horn,
22, of Coaldale, was placed for six months on a charge of possession of drug paraphernalia. She was arrested on June 2 by Lansford police at Patterson and Center streets.
She was assessed $650 and ordered to get a drug and alcohol evaluation.
Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
